Описание:

Contemporary law and public policy often treat human beings as selfish creatures who respond only to punishments and rewards. Yet every day we behave unselfishly--few of us mug the elderly or steal the paper from our neighbors yard, and many of us go out of our way to help strangers. We nevertheless overlook our own good behavior and fixate on the bad things people do and how we can stop them. In this pathbreaking book, acclaimed law and economics scholar Lynn Stout argues that this focus neglects the crucial role our better impulses could play in society. Rather than lean on the power of greed to shape laws and human behavior, Stout contends that we should rely on the force of conscience.

Stout makes the compelling case that conscience is neither a rare nor quirky phenomenon, but a vital force woven into our daily lives. Drawing from social psychology, behavioral economics, and evolutionary biology, Stout demonstrates how social cues--instructions from authorities, ideas about others selfishness and unselfishness, and beliefs about benefits to others--have a powerful role in triggering unselfish behavior. Stout illustrates how our legal system can use these social cues to craft better laws that encourage more unselfish, ethical behavior in many realms, including politics and business. Stout also shows how our current emphasis on self-interest and incentives may have contributed to the catastrophic political missteps and financial scandals of recent memory by encouraging corrupt and selfish actions, and undermining societys collective moral compass.

This book proves that if we care about effective laws and civilized society, the powers of conscience are simply too important for us to ignore.

Описание: This book is about conscience and love in making judicial decisions. It looks at law not as a body of rigid rules applied by emotionless judges, but as a creative process in which the judges make their fundamental choices. The judges do love and they do hate when they make their decisions. On the basis of the rich tradition of Christian ethics, the author addresses the question: why should the judges love those who are affected by their decisions, and how do they do that? Readership: Academics and anyone interested in philosophy of law and legal ethics.

Moral Differences: Truth, Justice, and Conscience in a World of Conflict

Описание:

In a wide-ranging inquiry Richard W. Miller provides new resources for coping with the most troubling types of moral conflict: disagreements in moral conviction, conflicting interests, and the tension between conscience and desires. Drawing on most fields in philosophy and the social sciences, including his previous work in the philosophy of science, he presents an account of our access to moral truth, and, within this framework, develops a theory of justice and an assessment of the role of morality in rational choice. In Miller's view, we are often in a position to claim that our moral judgments are true descriptions of moral facts. But others, relying on contrary ways of moral learning, would reject truths that we are in a position to assert, in dissent that does not depend on irrationality or ignorance of relevant evidence or arguments. With this mixed verdict on "moral realism," Miller challenges many received views of rationality, scientific method, and the relation between moral belief and moral choice. In his discussion of justice, Miller defends the adequacy, for modern political choices, of a widely shared demand that institutions be freely and rationally acceptable to all. Drawing on social research and economic theories, he argues that this demand has dramatically egalitarian consequences, even though it is a premise of liberals and conservatives alike. In the final chapters, Miller investigates the role and limits of morality in the choice of conduct, arguing for new perspectives on reason and impartiality.

The Renaissance Conscience

Автор: Braun

Описание: The Renaissance Conscience presents one of the first modern studies to explore the variety of ways in which people during the Renaissance conversed with - and let themselves be guided by - their conscience. Through the careful examination of a wide range of extant sources including theological manuals, legal treatises, letters, and literary and autobiographical texts, the authors illustrate how individuals in England and the Hispanic world during the period of the Renaissance sought to reconcile their private and public selves, and thus establish and protect their identity. Individual essays demonstrate the significance, diversity, and fluidity of notions of conscience in the early modern world. These thought-provoking case studies also reveal how authority figures and commoners from two distinct cultural spheres struggled with similar issues and did so with explicit reference to shared scholastic and humanist traditions - often with similar outcomes. The Renaissance Conscience sheds important new light on the ways in which medieval and Renaissance discourses on conscience impacted upon early modern life and anticipated contemporary notions of moral autonomy.

Описание: Our society's longstanding commitment to the liberty of conscience has become strained by our increasingly muddled understanding of what conscience is and why we value it. Too often we equate conscience with individual autonomy, and so we reflexively favor the individual in any contest against group authority, losing sight of the fact that a vibrant liberty of conscience requires a vibrant marketplace of morally distinct groups. Defending individual autonomy is not the same as defending the liberty of conscience because, although conscience is inescapably personal, it is also inescapably relational. Conscience is formed, articulated, and lived out through relationships, and its viability depends on the law's willingness to protect the associations and venues through which individual consciences can flourish: these are the myriad institutions that make up the space between the person and the state. Conscience and the Common Good reframes the debate about conscience by bringing its relational dimension into focus.
