Описание: In Patriotism and Piety, Jonathan Den Hartog argues that the question of how religion would function in American society was decided in the decades after the Constitution and First Amendment established a legal framework. Den Hartog shows that among the wide array of politicians and public figures struggling to define religion’s place in the new nation, Federalists stood out - evolving religious attitudes were central to Federalism, and the encounter with Federalism strongly shaped American Christianity.Den Hartog describes the Federalist appropriations of religion as passing through three stages: a “republican” phase of easy cooperation inherited from the experience of the American Revolution; a “combative” phase, forged during the political battles of the 1790s–1800s, when the destiny of the republic was hotly contested; and a “voluntarist” phase that grew in importance after 1800. Faith became more individualistic and issue-oriented as a result of the actions of religious Federalists.Religious impulses fueled party activism and informed governance, but the redirection of religious energies into voluntary societies sapped party momentum, and religious differences led to intraparty splits. These developments altered not only the Federalist Party but also the practice and perception of religion in America, as Federalist insights helped to create spaces of voluntary, national organizations in which Americans could practice their faith in interdenominational settings.Patriotism and Piety focuses on the experiences and challenges confronted by a number of Federalists, from well-known leaders such as John Adams, John Jay, Charles Cotesworth Pinckney, and Timothy Dwight to lesser-known but still important figures such as Caleb Strong, Elias Boudinot, and William Jay.
Описание: Over the last thirty years, the Federalist Society for Law and Public Policy Studies has grown from a small group of disaffected conservative law students into an organisation with extraordinary influence over American law and politics.

Although the organisation is unknown to the average citizen, this group of intellectuals has managed to monopolise the selection of federal judges, take over the Department of Justice, and control legal policy in the White House.

Today the Society claims that 45,000 conservative lawyers and law students are involved in its activities. Four Supreme Court Justices - Antonin Scalia, Clarence Thomas, John Roberts, and Samuel Alito - are current or former members. Every single federal judge appointed in the two Bush presidencies was either a Society member or approved by members. During the Bush years, young Federalist Society lawyers dominated the legal staffs of the Justice Department and other important government agencies.

The Society has lawyer chapters in every major city in the United States and student chapters in every accredited law school. Its membership includes economic conservatives, social conservatives, Christian conservatives, and libertarians, who differ with each other on significant issues, but who cooperate in advancing a broad conservative agenda.

How did this happen?

How did this group of conservatives succeed in moving their theories into the mainstream of legal thought?

What is the range of positions of those associated with the Federalist Society in areas of legal and political controversy?

The authors survey these stances in separate chapters on regulation of business and private property; race and gender discrimination and affirmative action; personal sexual autonomy, including abortion and gay rights; and American exceptionalism and international law.

Описание: In Framed, Levinson challenges our belief that the most important features of our constitutions concern what rights they protect. Instead, he focuses on the fundamental procedures of governance. Levinson argues that we should stop treating the United States Constitution as uniquely exemplifying the American constitutional tradition. Given the experience of so many states, he writes, surely it is reasonable to believe that the U.S. Constitution merits its ownupdating.
Описание: This book reconnects The Federalist Papers to the study of American politics and political development, arguing that the papers contain previously unrecognized theory of institutional power, a theory that enlarges and refines the contribution of the papers to political theory, but also reconnects the papers to the study of American politics.
