Описание: This book provides a complete overview of the American Founders' political theory, covering natural rights, natural law, state of nature, social compact, consent, and the policy implications of these ideas. The book is intended as a response to the current scholarly consensus, which holds that the Founders' political thought is best understood as an amalgam of liberalism, republicanism, and perhaps other traditions. West argues that, on the contrary, the foundational documents overwhelmingly point to natural rights as the lens through which all politics is understood. The book explores in depth how the Founders' supposedly republican policies on citizen character formation do not contradict but instead complement their liberal policies on property and economics. Additionally, the book shows how the Founders' embraced other traditions in their politics, such as common law and Protestantism.

The First Presidential Contest: 1796 and the Founding of American Democracy

Описание: This is the first study in half a century to focus on the election of 1796. The first contested presidential election offered neither a structured campaign—the candidates did not even deign to participate—nor an analysable national vote. Not only were political parties not yet institutionalised, they were ignored by the Constitution and frowned upon by the Founders. Pasley contends, however, that 1796 set the stage for all of American politics to follow.

Challenging much of the conventional understanding of this election, Pasley argues that Federalist and Democratic-Republican were deeply meaningful categories for politicians and citizens of the 1790s, even if the names could be inconsistent and the institutional presence lacking. He treats the 1796 election as a rough draft of the democratic presidential campaigns that came later rather than as the personal squabble depicted by other historians. It set the geographic pattern of New England competing with the South at the two extremes of American politics, and it established the basic ideological dynamic of a liberal, rights-spreading American left arrayed against a conservative, society-protecting right, each with its own competing model of leadership.

Rather than the inner thoughts and personal lives of the Founders, covered in so many other volumes, Pasley focuses on images of Adams and Jefferson created by supporters—and detractors—through the press, capturing the way that ordinary citizens in 1796 would have actually experienced candidates they never heard speak. Newspaper editors, minor officials, now forgotten congressman, and individual elector candidates all take a leading role in the story to show how politics of the day actually worked.

Pasley’s cogent study rescues the election of 1796 from the shadow of 1800 and invites us to rethink how we view that campaign and the origins of American politics.

Описание:

American governance is burdened by a paradox. On the one hand, Americans don't want "big government" meddling in their lives; on the other hand, they have repeatedly enlisted governmental help to impose their views regarding marriage, abortion, religion, and schooling on their neighbors. These contradictory stances on the role of public power have paralyzed policymaking and generated rancorous disputes about government's legitimate scope. How did we reach this political impasse? Historian Gary Gerstle, looking at two hundred years of U.S. history, argues that the roots of the current crisis lie in two contrasting theories of power that the Framers inscribed in the Constitution.

One theory shaped the federal government, setting limits on its power in order to protect personal liberty. Another theory molded the states, authorizing them to go to extraordinary lengths, even to the point of violating individual rights, to advance the "good and welfare of the commonwealth." The Framers believed these theories could coexist comfortably, but conflict between the two has largely defined American history. Gerstle shows how national political leaders improvised brilliantly to stretch the power of the federal government beyond where it was meant to go--but at the cost of giving private interests and state governments too much sway over public policy. The states could be innovative, too. More impressive was their staying power. Only in the 1960s did the federal government, impelled by the Cold War and civil rights movement, definitively assert its primacy. But as the power of the central state expanded, its constitutional authority did not keep pace. Conservatives rebelled, making the battle over government's proper dominion the defining issue of our time.

From the Revolution to the Tea Party, and the Bill of Rights to the national security state, Liberty and Coercion is a revelatory account of the making and unmaking of government in America.

Описание:

The arrival of European and Euro-American colonizers in the Americas brought not only physical attacks against Native American tribes, but also further attacks against the sovereignty of these Indian nations. Though the violent tales of the Trail of Tears, Black Hawk's War, and the Battle of Little Big Horn are taught far and wide, the political structure and development of Native American tribes, and the effect of American domination on Native American sovereignty, have been greatly neglected.
This book contains a variety of primary source and other documents--traditional accounts, tribal constitutions, legal codes, business councils, rules and regulations, BIA agents reports, congressional discourse, intertribal compacts--written both by Natives from many different nations and some non-Natives, that reflect how indigenous peoples continued to exercise a significant measure of self-determination long after it was presumed to have been lost, surrendered, or vanquished. The documents are arranged chronologically, and Wilkins provides brief, introductory essays to each document, placing them within the proper context. Each introduction is followed by a brief list of suggestions for further reading.
Covering a fascinating and relatively unknown period in Native American history, from the earliest examples of indigenous political writings to the formal constitutions crafted just before the American intervention of the Indian Reorganization Act of 1934, this anthology will be an invaluable resource for scholars and students of the political development of indigenous peoples the world over.
