Описание: This book explores the question of how international law is applied by domestic courts. Through case studies and analysis the contributors consider how traditions and diversity affect the interpretation of international law, from a mixture of doctrinal, practical, and theoretical approaches.
Описание: The more international law, taken as a global answer to global problems, intrudes into domestic legal systems, the more it takes on the role and function of domestic law. This raises a separation of powers question regarding law–making powers. This book considers that specific issue. In contrast to other studies on domestic courts applying international law, its constitutional orientation focuses on the presumptions concerning the distribution of state power. It collects and examines relevant decisions regarding treaties and customary international law from four leading legal systems, the US, the UK, France, and the Netherlands. Those decisions reveal that institutional and conceptual allegiances to constitutional structures render it difficult for courts to see their mandates and powers in terms other than exclusively national. Constitutionalism generates an inevitable dualism between international law and national law, one which cannot necessarily be overcome by express constitutional provisions accommodating international law. Valuable for academics and practitioners in the fields of international and constitutional law.

Описание: In this stimulating and highly original study of the writing of American history, twenty-four scholars from eleven European countries explore the impact of writing history from abroad. Six distinguished scholars from around the world add their commentaries. Arguing that historical writing is conditioned, crucially, by the place from which it is written, this volume identifies the formative impact of a wide variety of institutional and cultural factors that are commonly overlooked. Examining how American history is written from Europe, the contributors shed light on how history is written in the United States and, indeed, on the way history is written anywhere. The innovative perspectives included in Historians across Borders are designed to reinvigorate American historiography as the rise of global and transnational history is creating a critical need to understand the impact of place on the writing and teaching of history. This book is designed for students in historiography, global and transnational history, and related courses in the United States and abroad, for US historians, and for anyone interested in how historians work.
Описание: Beyond Borders: A History of Mexican Migration to the United States details the origins and evolution of the movement of people from Mexico into the United States from the first significant flow across the border at the turn of the twentieth century up to the present day.
Описание: This work offers a timely philosophical analysis of interrelated normative questions concerning immigration and citizenship in relation to the global context of multiple nation states. In it, philosophers and scholars from the social sciences address both fundamental questions in moral and political philosophy as well as specific issues concerning policy. Topics covered in this volume include: the concept and the role of citizenship, the equal rights and representation of citizens, general moral frameworks for addressing immigration issues, the duty to obey immigration law, the use of ethnic, cultural, or linguistic criteria for selective immigration, domestic violence as grounds for political asylum, and our duty to refugees in general. The urgency of the need to discuss these matters is clear. Several humanitarian crises involving human migration across national boundaries stemming from war, economic devastations, gang violence, and violence in ethnic or religious conflicts have unfolded. Political debates concerning immigration and immigrant communities are continuing in many countries, especially during election years. While there have always been migrating human beings, they raise distinctive issues in the modern era because of the political context under which the migrations take place, namely, that of a system of sovereign nation states with rights to control their borders and determine their memberships. This collection provides readers the opportunity to parse these complex issues with the help of diverse philosophical, moral, and political perspectives.
Описание: A dramatic rise in ``nones``-individuals without religious affiliation-has taken place in less than two decades. Many of these people are seekers who self-identify as ``spiritual but not religious (SBNR).`` In Belief without Borders, theologian Linda Mercadante, once an SBNR herself, sets out to find them and let them speak for themselves.

Описание: Maps and challenges many of the mythologies that surround the late iconic labor leader. Focusing on Chavez`s own writings, this book argues that La Causa can be fruitfully understood as a quasi-religious movement based on Chavez`s charismatic leadership, which he modeled after Martin Luther King Jr and Gandhi.

Описание: A resource for all who teach and study history, this book illuminates the unmistakable centrality of American Indian history to the full sweep of American history. The nineteen essays gathered in this collaboratively produced volume, written by leading scholars in the field of Native American history, reflect the newest directions of the field and are organized to follow the chronological arc of the standard American history survey. Contributors reassess major events, themes, groups of historical actors, and approaches--social, cultural, military, and political--consistently demonstrating how Native American people, and questions of Native American sovereignty, have animated all the ways we consider the nation's past. The uniqueness of Indigenous history, as interwoven more fully in the American story, will challenge students to think in new ways about larger themes in U.S. history, such as settlement and colonization, economic and political power, citizenship and movements for equality, and the fundamental question of what it means to be an American.Contributors are Juliana Barr, Susan Sleeper-Smith, James D. Rice, Sarah M. S. Pearsall, Adam Jortner, Robert J. Miller, Jean M. O'Brien, Paul T. Conrad, Scott Manning Stevens, Jeffrey Ostler, Phillip H. Round, Mindy J. Morgan, John J. Laukaitis, David R. M. Описание: The authors discussed in this book, including James Fenimore Cooper, William Faulkner, Toni Morrison, Alice Walker, and Leslie Marmon Silko, place this cross-cultural contact in nature, not only collapsing cultural and racial boundaries, but also complicating divisions between `wilderness` and `civilization.`
Описание: Empires Without Imperialism shows how at the times of their decline, elites in both the UK and the US utilized the attributes of an imagined past to essentialize the nature of the liberal state.
Описание: This book attempts to solve an enduring puzzle in women`s electoral politics. Namely why the increasing importance of women`s votes in the 1920s did not imply increasing success for the lobbying efforts of women`s organizations.
