Описание: In recent years, members of legal, law enforcement, media and academic circles have portrayed rape as a special kind of crime distinct from other forms of violence. In Framing the Rape Victim, Carine M. Mardorossian argues that this differential treatment of rape has exacerbated the ghettoising of sexual violence along gendered lines and has repeatedly led to women’s being accused of triggering, if not causing, rape through immodest behaviour, comportment, passivity or weakness.Contesting the notion that rape is the result of deviant behaviours of victims or perpetrators, Mardorossian argues that rape saturates our culture and defines masculinity’s relation to femininity, both of which are structural positions rather than biologically derived ones. Using diverse examples throughout, Mardorossian draws from Hollywood film and popular culture to contemporary women’s fiction and hospitalised birth emphasising that the position of dominant masculinity can be occupied by men, women or institutions, while structural femininity is a position that may define and subordinate men, minorities and other marginalised groups just as effectively as it does women. Highlighting the legacies of the politically correct debates of the 1990s and the terrorist attacks of 9/11, the book illustrates how the framing of the term “victim” has played a fundamental role in constructing notions of agency that valorise autonomy and support exclusionary, especially masculine, models of American selfhood. The gendering of rape, including by well-meaning, sometimes feminist, voices that claim to have victims’ best interests at heart, ultimately obscures its true role in our culture. Both a critical analysis and a call to action, Framing the Rape Victim shows that rape is not a special interest issue that pertains just to women but a pervasive one that affects our society as a whole.

Описание: Lawrence C. Becker introduces an unconventional set of background ideas for future philosophical work on normative theories of basic justice. The organizing concept is habilitation -- the process of equipping a person or thing with functional abilities or capacities. The specific proposals drawn from the concept of habilitation are independent of any particular set of distributive principles. The result is a framework for theory that includes a metric for the pursuit of basic justice, but not a normative theory of it. The basic idea is that receiving and providing habilitation is a lifelong necessity for human beings, from their nearly helpless newborn state through their struggles to survive and thrive thereafter, even into the most severe diminishments of old age. This lifelong human necessity underlies all questions about basic justice, and the possibilities for habilitation define the circumstances under which those questions arise. Focusing on the circumstances of habilitation calls attention to the central role of physical and psychological health. Without basic good health in both domains, it is not possible to cope with the habilitative demands of one's physical and psychological endowments, and one's physical and social environments. And for human beings, a particular aspect of human health effectively sums up these matters: namely human agency; the nature and extent of the ability to act effectively. The book proposes, specifically, that normative theories of basic justice adopt the habilitation framework. What then appears to follow is that the most plausible comprehensive metric for assessing progress toward basic justice will be the level and distribution of basic good health. Moreover, achieving robustly healthy agency will be the most plausible tactical target for making progress toward basic justice -- no matter what one's favored distributive principles might be.

Описание: Poverty, Agency, and Human Rights collects thirteen new philosophical papers that focus on the diverse ways poverty impacts the agency of the poor, the reasons why poverty alleviation schemes should also promote the agency of beneficiaries, and the fitness of the human rights regime to secure both economic development and free agency.
Описание: Being human while trying to scientifically study human nature confronts us with our most vexing problem. What we need to move forward in our understanding of human agency, this book argues, is a reform in the way we study ourselves and a long overdue break with traditional humanist thinking.
