This book explores the objectives pursued in donor programs, the methods used to advance them, and the underlying assumptions and strategies. It emphasizes the unexpected and sometimes unpleasant consequences of ignoring not only political and societal constraints but also advances in our technical approaches to performance improvement, the one area where the First World has a comparative advantage. The geographic scope of the work is broad, incorporating examples from Eastern and Central Europe, Latin America, Africa, and the Asia-Pacific region as well as from several First World nations.

Justice Reform and Development examines First World assistance to justice or rule of law reforms in developing and transitional societies, arguing that its purported failure is vastly exaggerated, largely because of unrealistic expectations as to what could be accomplished. Change nonetheless is needed if the programs are to continue and would be best based on targeting specific performance problems, incorporation of donor countries experience with their own reforms, and greater attention to relevant research.

While contributing to an on-going debate among practitioners and academics involved in justice programs, this book will also be accessible to readers with little exposure to the topics, especially advanced undergraduate and graduate students in law, political science and areas studies.

Описание: In development, stabilization, and peace building, donors increasingly recognize the importance of being sensitive to the local contexts of their efforts. Yet the use of "blueprints" remains widespread. Even when standard approaches are modified for particular aid partners, there often remains a poor fit between donor efforts and local conditions. When recipients cannot absorb the aid and attention they are offered, the common response is "capacity building." While it is true that many aid recipients do not have adequate capacity for implementation, this report presents the results of a case study demonstrating that some security and justice programs are designed and implemented without an adequate appreciation of local desires, resources, capabilities, and challenges. Absorptive capacity, in other words, is a byproduct of the donor-recipient relationship. An earlier study by the authors introduced a new framework for measuring absorptive capacity. This volume applies it to security and justice sector programs that did not meet all of their objectives in Lebanon, Cambodia, and Colombia.

The book explores theoretical, methodological, and empirical underpinnings of administrative culture as well as prospects and challenges associated with it in the context of and across developing and transitional countries. Referring to dominant norms and values in public organizations administrative culture is about the attitudes and perceptions of public officials. In many countries civil servants are criticised for being corrupt, incompetent, unreliable and self-centred. Their attitudes, norms and values and the way they act are in constant conflict with rule of law. Recently the virtues of the Weberian model of bureaucracy have been reclaimed as an alternative to New Public Management (NPM): i.e. as a model which emphasizes impartiality, rule-following, expertise, and hierarchy rather than manipulation of incentive structures and market competition. In particular it has been argued that a system of meritocratic recruitment and predictable, long-term careers increases the professional competence of the bureaucrats and fosters a culture of professionalism among them. Still it is unclear how and under what conditions such a model can be adopted. Among main hindrances seems to be established power structures and the existing political and societal culture which undermine the effective implementation of the Weberian model.

This book was published as a special issue of the International Journal of Public Administration.
