Описание: Model Contract Clauses is an easy-to-use reference manual. Each contract subject includes: an introduction to each contract subject; a "drafting guide" to each subject; a "plain English" summary of the sample clauses; actual model clauses; and pages for taking notes and drafting proposals. Most sections have between three and five sample clauses. The clauses have been selected for being representative examples of clauses you might expect to find in most labor agreements. The idea is to expose the reader to as many different types of solutions to these bargaining issues as possible. Employers or unions in contract negotiations can use the sample clauses in this book as models for their own proposals. An employer, for example, responding to a proposal on seniority provisions may not be aware of the many different ways that companies and unions have agreed to handle these problems in the past. The clauses in this text are taken from actual contracts. They provide examples of how companies and unions have resolved the myriad issues that often come up in collective bargaining. Beginning negotiators faced with a proposal for a clause they have never heard of before (what the heck is a "zipper" and do I need one?), will find at least a couple of examples here, along with commentary, Phillip B. Описание: Do you spend your days fighting one employee relations fire after another? It may seem like job security, but it is stressful and unproductive. The U.S. Army discovered in Afghanistan and Iraq that jumping from one fire to the next isn't just unproductive, it costs lives. Instead of reacting to "boom" events the Army learned that proactively working "Left of Boom" prevented tragedies and saved lives. This book provides a practical "how-to" guide to implement these important lessons in your company. The results will astound you. This book, like many others, is about transformation and change. My focus is on change in organizations; more specifically about transforming employee relations environments in companies that have recently won union organizing campaigns. Yet fundamentally its lessons are about moving any group from a state of negative energy to one of positive energy.Physics teaches that it takes a considerable amount of energy to change direction or momentum, much more than it takes to simply continue going in the same direction. The same thing is true with organizations. In organizations this means it is much easier to satay mired in negativity (complaining, second-guessing and undermining others) than to change direction and become positive. In my experience. When it comes to organizational change, the physics equations may be too optimistic.Phillip B. Wilson, Esq. is President and General Counsel of Labor Relations Institute, Inc.
