Описание: The Grand Chamber of the European Court of Human Rights deals with the cases which raise most important and leading legal issues and serious questions affecting the interpretation and application of the European Convention of Human Rights. Its decisions and judgements represent the leading case-law of the Court, which is relevant, decisive, influencing and binding for the legal opinions of the Chambers. This book contains a collection of judgements and decisions of the Grand Chamber of the ‘new’ European Court of Human Rights (’the Court’), adopted since November 1998, classified in a chronological order. Each part includes a summary of relevant facts and the Court’s legal analyses and opinions. This book is a useful and practical tool for legal and human rights professionals, judges, advocates, law professors, academics, students and legal experts and is accessible to the large public involved in human rights and humanitarian affairs as well.

Описание: Now in its third edition, Taking a Case to the European Court of Human Rights provides practical and accessible guidance on taking cases to the European Court of Human Rights. It incorporates a step-by-step approach to the litigation process, covering areas such as lodging the initial application, legal aid, costs, interim measures, friendly settlement, third party intervention, just satisfaction, enforcement of judgments, and Grand Chamber referrals.
An explanation of the key principles underlying the European Convention on Human Rights precedes an expanded and up-to-date article-by-article commentary on the substantive law of the European Convention, including derogation, reservation, and damages. The new edition has been fully revised to take account of the changes introduced by Protocol 14 in 2010.
The book includes key substantive case law developments, commentary and guidance on the amended Court rules and new practice directions, and recent changes in the Court's processing of cases, together with advice and information on drafting pleadings, fact-finding and merits hearings before the Court.
The Court's admissibility criteria, a critical aspect of the Convention system, are dealt with in detail, and a comprehensive set of Court forms and other precedents are included in the appendices.

Описание: The European Court of Human Rights in the Post-Cold War Era: Universality in Transition examines transitional justice from the perspective of its impact on the universality of human rights, taking the jurisprudence of the European Court of Human Rights as its detailed case study. The problem is twofold: there are questions about differences in human rights standards between transitional and non-transitional situations, and about differences between transitions. The European Court has been a vital part of European democratic consolidation and integration for over half a century, setting meaningful standards and offering legal remedies to the individually repressed, the politically vulnerable, and the socially excluded. After their emancipation from Soviet influence in the 1990s, and with membership of the European Union in mind for many, the new democracies of Central and Eastern Europe flocked to the Convention system. The voluminous jurisprudence of the European Court of Human Rights can now give us some clear information about how an international human rights law regime can interact with transitional justice. The jurisprudence is divided between those cases concerning the human rights implications of explicitly transitional policies (such as lustration), and those that involve impacts upon specific democratic rights during the transition. The book presents a close examination of claims by states that transitional policies and priorities require a level of deference from the Strasbourg institutions. The book proposes that states’ claims for leeway from international human rights supervisory mechanisms during times of transition can be characterised not as arguments for cultural relativism, but for ‘transitional relativism’.

Описание:

Homosexuality and the European Court of Human Rights is the first book-length study of the Court's jurisprudence in respect of sexual orientation. It offers a socio-legal analysis of the substantial number of decisions and judgments of the Strasbourg organs on the wide range of complaints brought by gay men and lesbians under the European Convention on Human Rights. Providing a systematic analysis of Strasbourg case law since 1955 and examining decades of decisions that have hitherto remained obscure, the book considers the evolution of the Court's interpretation of the Convention and how this has fashioned lesbian and gay rights in Europe. Going beyond doctrinal analysis by employing a nuanced sociological consideration of Strasbourg jurisprudence, Paul Johnson shows how the Court is a site at which homosexuality is both socially constructed and regulated. He argues that although the Convention is conceived as a 'living instrument' to be interpreted 'in the light of present-day conditions' the Court's judgments have frequently forged and advanced new social conditions in respect of homosexuality. Johnson argues that the Court's jurisprudence has an extra-legal importance because it provides an authoritative and powerful discursive resource that can be mobilized by lesbians and gay men to challenge homophobic and heteronormative social relations in contemporary societies. As such, the book considers how the Court's interpretation of the Convention might be evolved in the future to better protect lesbian and gay rights and lives.

Описание: The ECHR protects human rights in more than 40 European countries. Ifates fail to meet standards required by the Convention, victims of violations can complain to the Strasbourg Court. This book examines both the substance and procedure under the ECHR, and follows the structure of the Convention itself in explaining the key principles established by Strasbourg case law and procedural aspects of bringing a claim before the Court.
