Описание: The question of how moral and legal reasoning interact has been a central focus in modern legal philosophy. Matthew Kramer here analyses the diverse ways in which moral principles enter legal systems, and presents a staunch defence of the `separability` thesis - that law is not inherently moral in its effects or motivational underpinnings.

Описание: Law, Economics, and Morality examines the possibility of combining economic methodology and deontological morality through explicit and direct incorporation of moral constraints into economic models. Economic analysis of law is a powerful analytical methodology. However, as a purely consequentialist approach, which determines the desirability of acts and rules solely by assessing the goodness of their outcomes, standard cost-benefit analysis (CBA) is normatively objectionable. Moderate deontology prioritizes such values as autonomy, basic liberties, truth-telling, and promise-keeping over the promotion of good outcomes. It holds that there are constraints on promoting the good. Such constraints may be overridden only if enough good (or bad) is at stake. While moderate deontology conforms to prevailing moral intuitions and legal doctrines, it is arguably lacking in methodological rigor and precision. Eyal Zamir and Barak Medina argue that the normative flaws of economic analysis can be rectified without relinquishing its methodological advantages and that moral constraints can be formalized so as to make their analysis more rigorous. They discuss various substantive and methodological choices involved in modeling deontological constraints. Zamir and Medina propose to determine the permissibility of any act or rule infringing a deontological constraint by means of mathematical threshold functions. Law, Economics, and Morality presents the general structure of threshold functions, analyzes their elements and addresses possible objections to this proposal. It then illustrates the implementation of constrained CBA in several legal fields, including contract law, freedom of speech, antidiscrimination law, the fight against terrorism, and legal paternalism.

Описание: Moral Failure: On the Impossible Demands of Morality asks what happens when the sense that "I must" collides with the realization that "I can`t." Bringing together philosophical and empirical work in moral psychology, Lisa Tessman here examines moral requirements that are non-negotiable and that contravene the principle that "ought implies can."

Описание:
Ever since Plato's 'Republic' was written over two thousand years ago, one of the main concerns of social philosophy and later empirical social science was to understand the moral nature of human beings. The faculty to think and act in terms of overarching moral values is as much a defining hallmark of our species as is our intelligence, so homo moralis is no less an appropriate term to describe humans as homo sapiens.
This volume makes a case for the pivotal role of social psychology as the core discipline for studying morality. The book is divided into four parts. First, the role of social psychological processes in moral values and judgments is discussed, followed by an analysis of the role of morality in interpersonal processes. The sometimes paradoxical, ironic effects of moral beliefs are described next, and in the final section the role of morality in collective and group behavior is considered.
This book will be of interest to students and researchers in the social and behavioral sciences concerned with moral behavior, as well as professionals and practitioners in clinical, counseling, organizational, marketing and educational psychology where issues of ethics and morality are of importance.
Описание: What is the difference between right and wrong? This is no easy question to answer, yet we constantly try to make it so, frequently appealing to some hidden cache of cut-and-dried absolutes, whether drawn from God, universal reason, or societal authority. Combining cognitive science with a pragmatist philosophical framework in Morality for Humans: Ethical Understanding from the Perspective of Cognitive Science, Mark Johnson argues that appealing solely to absolute principles and values is not only scientifically unsound but even morally suspect. He shows that the standards for the kinds of people we should be and how we should treat one another--which we often think of as universal--are in fact frequently subject to change. And we should be okay with that. Taking context into consideration, he offers a remarkably nuanced, naturalistic view of ethics that sees us creatively adapt our standards according to given needs, emerging problems, and social interactions. Ethical naturalism is not just a revamped form of relativism. Indeed, Johnson attempts to overcome the absolutist-versus-relativist impasse that has been one of the most intractable problems in the history of philosophy. He does so through a careful and inclusive look at the many ways we reason about right and wrong. Much of our moral thought, he shows, is automatic and intuitive, gut feelings that we follow up and attempt to justify with rational analysis and argument. However, good moral deliberation is not limited merely to intuitive judgments supported after the fact by reasoning. Johnson points out a crucial third element: we imagine how our decisions will play out, how we or the world would change with each action we might take. Plumbing this imaginative dimension of moral reasoning, he provides a psychologically sophisticated view of moral problem solving, one perfectly suited for the embodied, culturally embedded, and ever-developing human creatures that we are.
Most international relations specialists since World War II have assumed that morality plays only the most peripheral role in the making of substantive foreign policy decisions. To show that moral norms can, and do, significantly affect international affairs, Robert McElroy investigates four cases of American foreign policy-making: U.S. food aid to the Soviet Union during the Russian famine of 1921, Nixon's decision to alter U.S. policies on biochemical weapons production in 1969, the signing of the Panama Canal Treaties in 1978, and the bombing of Dresden during World War II.
