Описание: This volume explores the factors that give rise to the number of people seeking asylum and examines the barriers they currently and will continue to face. Divided into three parts, the authors first explore the causality that generates displacement, examining climate change, illegal conflicts and the deprivation of natural resources. They argue that all of these problems either originate from human agency directly, or are strongly influenced by human activities, particularly those of wealthy countries in the North West. The study goes on to discuss how migrants are received and the problems they face on arrival, and concludes with confronting the fate and the status of asylum seekers after arrival, and the walls, both virtual and material, that they encounter. The authors propose ways of approaching the situation, beyond the present language and the limited interpretations of the Convention on the Status of Refugees. Written by leading experts in environmental ethics, asylum law, and international law, the book will be essential reading for those working in these and related areas.

Описание: This book addresses the intersection of various domains of international law (refugee law, human rights law including child rights international law and humanitarian law) in terms of the implications for State obligations to child refugee asylum seekers in particular; both as collectives and as individual persons. How these State obligations have been interpreted and translated into practice in different jurisdictions is explored through selected problematic significant cases. Further, various threats to refugee children realizing their asylum rights, including refoulement of these children through State extraterritorial and pushback migration control strategies, are highlighted through selected case law. The argument is made that child refugee asylum seekers must not be considered, in theory or in practice, beyond the protection of the law if the international rule of law grounded on respect for human dignity and human rights is in fact to prevail.
This open access monograph provides sociological insight into governmental action on the administration of asylum in the European context. It offers an in-depth understanding of how decision-making officials encounter and respond to structural contradictions in the asylum procedure produced by diverging legal, political, and administrative objectives.
The study focuses on structural aspects on the one hand, such as legal and organisational elements, and aspects of agency on the other hand, examining the social practices and processes going on at the frontside and the backside of the administrative asylum system.
Coverage is based on a case study using ethnographic methods, including qualitative interviews, participant observation, as well as artefact analysis. This case study is positioned within a broader context and allows for comparison within and beyond the European system, building a bridge to the international scientific community.
In addition, the author links the empirical findings to sociological theory. She explains the identified patterns of social practice in asylum administration along the theories of social practices, social construction and structuration. This helps to contribute to the often missing theoretical development in this particular field of research.
Overall, this book provides a sociological contribution to a key issue in today's debate on immigration in Europe and beyond. It will appeal to researchers, policy makers, administrators, and practitioners as well as students and readers interested in immigration and asylum.

Описание: Since 2014, more than 60 million people have been displaced from their homes across the Middle East and Africa. The European Refugee Crisis, as it has come to be known, is now the largest such crisis since the aftermath of World War II. How have local communities reacted to the influx of asylum seekers? And what can we learn from their responses? Frances Trix here offers a wide-ranging ethnographical and anthropological study of local, individual responses to refugees, from Macedonia to Germany. Based on extensive interviews and field work in Europe, Trix focuses for the first time on the ways that refugees have been welcomed – or not, as the case may be – by various individuals and communities. Her work ranges from Macedonians who established an NGO and lobbied to allow the refugees to use the train, to the police charged with border management; from a German organic food store owner who by her actions set the positive tone in her village, a retired IT manager who coordinates refugee volunteers for his entire town, to the district work organisation director who deems refugees unsuitable for multiple reasons. The material is measured throughout against Trix’s anthropological experience, as well as reference to the historical and political contexts in which events are unfolding. This book is essential reading for all those working on the refugee crisis and the prospects – both local and global – for the future.

Families are actors and drivers in migration and refugee crises. However, the current protection frameworks privilege the individual over the family unit. Consequently, the stories of families in migration have remained under-researched and their challenges under-addressed. This volume explores the interplay between family, separation, and migration in the Middle East, West Africa, Southeast Asia, Europe, and Latin America, and in the context of the 2015 global refugee crisis. Guiding it are two questions: How do family, migration, and separation play out across geographical, political, and historical contexts? And what are the gaps in the protection of migrants and their families? Thirteen authors – academics and practitioners – discuss the international protection for refugees, migration governance, child mobility, disability and immigration, human trafficking, and dilemmas in refugee reporting. The book proposes a paradigm shift in the way we cater to the needs and aspirations of families on the move. Its authors offer evidence-based solutions that cut across polarized discussions on migration and refugees. As such, the volume is aimed at researchers, students, policymakers, and experts working in international relations, migration, human rights, and refugee protection.

Описание: In the late 1970s, 2000 Vietnamese arrived in Australia by boat, fleeing persecution. Their arrival presented a challenge to politicians, but the way the Fraser government handled it, and the resettlement of tens of thousands more Indochinese refugees, marked a turning point in Australia’s immigration history. Turn-backs and detention were proposed, and rejected.Claire Higgins’ important book recounts these extraordinary events. It is driven by the question of how we moved from a humanitarian approach to policies of mandatory detention ? including on remote islands ? and boat turn-backs. Like now, the politicians of the time wanted to control entry. Unlike now, they also wanted to respect Australia’s obligations under international law. It’s about how governments and policy-makers have dealt with the confluence of issues emerging from the end of the ‘White Australia’ policy, a recognition of international responsibilities, and shifting public opinion. Strikingly, it also shows the extent to which the attitudes and statements of politicians and policymakers can shape the mood of the country, for better and worse.
