Описание: In this volume, Brownson sheds new light on Palestinian Muslim womens agency in shari‘a courts from the British Mandate period to the present. Her extensive archival research on wife-initiated maintenance claims, divorce, and child custody cases deepens our understanding of womens position in the courts, demonstrating that Muslim women were and are active participants in their legal affairs. Using court registers and interviews, Brownson uncovers a variety of ways women have manipulated the system to their benefit despite its patriarchal bias. She also finds that few reforms were implemented during the Mandate period. The British were uninterested in improving colonized womens legal status and sought to avoid further antagonizing Palestinians. At the same time, Palestinians wished to uphold the one indigenous institution they still controlled while both British rule and Zionism threatened their nationalist aspirations. Although Palestinian women have had few alternatives to using this male privileged system to redress grievances with their husbands and in-laws, they continue to resist its injustices every day. Brownson finds that womens understanding of family law fundamentals has enabled some to deftly navigate the system; however, a unified, reformed law reflecting societys current needs is required so women can have full access to their rights.

Описание:

Men of Capital examines British-ruled Palestine in the 1930s and 1940s through a focus on economy. In a departure from the expected histories of Palestine, this book illuminates dynamic class constructions that aimed to shape a pan-Arab utopia in terms of free trade, profit accumulation, and private property. And in so doing, it positions Palestine and Palestinians in the larger world of Arab thought and social life, moving attention away from the limiting debates of Zionist–Palestinian conflict.

Reading Palestinian business periodicals, records, and correspondence, Sherene Seikaly reveals how capital accumulation was central to the conception of the ideal "social man." Here we meet a diverse set of characters—the man of capital, the frugal wife, the law-abiding Bedouin, the unemployed youth, and the abundant farmer—in new spaces like the black market, cafes and cinemas, and the idyllic Arab home. Seikaly also traces how British colonial institutions and policies regulated wartime austerity regimes, mapping the shortages of basic goods—such as the vegetable crisis of 1940—to the broader material disparities among Palestinians and European Jews. Ultimately, she shows that the economic is as central to social management as the political, and that an exclusive focus on national claims and conflicts hides the more complex changes of social life in Palestine.

Описание: French rule over Syria and Lebanon was premised on a vision of a special French protectorate established through centuries of cultural activity: archaeological, educational and charitable. Initial French methods of organising and supervising cultural activity sought to embrace this vision and to implement it in the exploitation of antiquities, the management and promotion of cultural heritage, the organisation of education and the control of public opinion among the literate classes. However, an examination of the first five years of the League of Nations-assigned mandate, 1920-1925, reveals that French expectations of a protectorate were quickly dashed by widespread resistance to their cultural policies, not simply among Arabists but also among minority groups initially expected to be loyal to the French. The violence of imposing the mandate 'de facto', starting with a landing of French troops in the Lebanese and Syrian coast in 1919 - and followed by extension to the Syrian interior in 1920 - was met by consistent violent revolt. Examining the role of cultural institutions reveals less violent yet similarly consistent contestation of the French mandate. The political discourses emerging after World War I fostered expectations of European tutelages that prepared local peoples for autonomy and independence. Yet, even among the most Francophile of stakeholders, the unfolding of the first years of French rule brought forth entirely different events and methods. In this book, Idir Ouahes provides an in-depth analysis of the shifts in discourses, attitudes and activities unfolding in French and locally-organised institutions such as schools, museums and newspapers, revealing how local resistance put pressure on cultural activity in the early years of the French mandate.

Описание:

Modeled after the BBC, the Palestine Broadcasting Service was launched in 1936 to serve as the national radio station of Mandate Palestine, playing a pivotal role in shaping the culture of the emerging middle class in the region. Despite its significance, the PBS has become nearly forgotten by scholars of twentieth-century Middle Eastern studies. Drawn extensively from British and Israeli archival sources, “This Is Jerusalem Calling” traces the compelling history of the PBS’s twelve years of operation, illuminating crucial aspects of a period when Jewish and Arab national movements simultaneously took form.

Andrea L. Stanton describes the ways in which the mandate government used broadcasting to cater to varied audiences, including rural Arab listeners, in an attempt to promote a “modern” vision of Arab Palestine as an urbane, politically sophisticated region. In addition to programming designed for the education of the peasantry, religious broadcasting was created to appeal to all three main faith communities in Palestine, which ultimately may have had a disintegrating, separatist effect. Stanton’s research brings to light the manifestation of Britain’s attempts to prepare its mandate state for self-governance while supporting the aims of Zionists. While the PBS did not create the conflict between Arab Palestinians and Zionists, the service reflected, articulated, and magnified such tensions during an era when radio broadcasting was becoming a key communication tool for emerging national identities around the globe.

Описание: One of the major questions facing the world today is the role of law in shaping identity and in balancing tradition with modernity. In an arid corner of the Mediterranean region in the first decades of the twentieth century, Mandate Palestine was confronting these very issues. Assaf Likhovski examines the legal history of Palestine, showing how law and identity interacted in a complex colonial society in which British rulers and Jewish and Arab subjects lived together. Law in Mandate Palestine was not merely an instrument of power or a method of solving individual disputes, says Likhovski. It was also a way of answering the question, ""Who are we?"" British officials, Jewish lawyers, and Arab scholars all turned to the law in their search for their identities, and all used it to create and disseminate a hybrid culture in which Western and non-Western norms existed simultaneously. Uncovering a rich arsenal of legal distinctions, notions, and doctrines used by lawyers to mediate between different identities, Likhovski provides a comprehensive account of the relationship between law and identity. His analysis suggests a new approach to both the legal history of Mandate Palestine and colonial societies in general.
