Описание: The question of what rights might be afforded to Indigenous peoples has preoccupied the municipal legal systems of settler states since the earliest colonial encounters. As a result of sustained institutional initiatives, many national legal regimes and the international legal order accept that Indigenous peoples possess an extensive array of legal rights. However, despite this development, claims advanced by Indigenous peoples relating to rights to marine spaces have been largely opposed. This book offers the first sustained study of these rights and their reception within modern legal systems. Taking a three-part approach, it looks firstly at the international aspects of Indigenous entitlements in marine spaces. It then goes on to explore specific country examples, before looking at some interdisciplinary themes of crucial importance to the question of the recognition of the rights of Indigenous peoples in marine settings. Drawing on the expertise of leading scholars, this is a rigorous and long-overdue exploration of a significant gap in the literature.

Описание: Beyond the generalisations of national and colonial history, what can we know about how Aboriginal nations interacted with the British settlers who invaded their country, the men appointed by the imperial and colonial governments to protect them, and each other? In The Good Country Bain Attwood makes a major contribution to our knowledge of this period by providing a superbly researched, finely grained local history of the Djadja Wurrung people of Central Victoria. The story is a shocking one, of destruction, decimation and dispossession, but, equally powerfully, it is not one of unceasing conflict. With reference to an unusually rich historical record, concepts such as the frontier and resistance emerge as inadequate in this context. Attwood recovers a good deal of the modus vivendi that the Djadja Wurrung reached with sympathetic protectors, pastoralists and gold diggers, showing how they both adopted and adapted to these intruders to remain in their own country, at least for a time. Finally, drawing past and present together, Attwood relates the remarkable story of the revival of the Djadja Wurrung in recent times as they have sought to become their own historians.

Описание: Since its establishment, the Jewish State has devoted major efforts to secure control over the land of Israel. One example is the protracted legal and territorial strife between the Israeli state and its indigenous Bedouin citizens over traditional tribal land in the Negev in southern Israel. Emptied Lands investigates this multifaceted land dispute, placing it in historical, legal, geographical, and comparative perspective. The authors provide the first legal geographic analysis of the "dead Negev doctrine," which has been used by Israel to dispossess Bedouin inhabitants and Judaize the southern half of the country. Through crafty use of Ottoman and British laws, particularly the concept of "dead land," Israel has constructed its own version of terra nullius. Yet, the indigenous property system still functions, creating an ongoing resistance to the Jewish state. This study examines several key land claims and rulings and alternative routes for justice promoted by indigenous communities and civil society movements.

Описание: On 13 September 2007, the United Nations General Assembly adopted the United Nations Declaration on the Rights of Indigenous Peoples. It marked the culmination of decades of struggle among indigenous peoples for a universal framework establishing minimum standards to ensure the survival, dignity and well-being of the indigenous peoples of the world. This publication looks back at ten-plus years of the Declaration’s existence—more than ten years both of implementation and progress and of unfulfilled expectations.

Описание: For millennia, plants and their habitats have been fundamental to the lives of Indigenous Peoples - as sources of food and nutrition, medicines, and technological materials - and central to ceremonial traditions, spiritual beliefs, narratives, and language. While the First Peoples of Canada and other parts of the world have developed deep cultural understandings of plants and their environments, this knowledge is often underrecognized in debates about land rights and title, reconciliation, treaty negotiations, and traditional territories. Plants, People, and Places argues that the time is long past due to recognize and accommodate Indigenous Peoples' relationships with plants and their ecosystems. Essays in this volume, by leading voices in philosophy, Indigenous law, and environmental sustainability, consider the critical importance of botanical and ecological knowledge to land rights and related legal and government policy, planning, and decision making in Canada, the United States, Sweden, and New Zealand. Analyzing specific cases in which Indigenous Peoples' inherent rights to the environment have been denied or restricted, this collection promotes future prosperity through more effective and just recognition of the historical use of and care for plants in Indigenous cultures. A timely book featuring Indigenous perspectives on reconciliation, environmental sustainability, and pathways toward ethnoecological restoration, Plants, People, and Places reveals how much there is to learn from the history of human relationships with nature.

Описание: Standard narratives of Native American history view the nineteenth century in terms of steadily declining Indigenous sovereignty, from removal of southeastern tribes to the 1887 General Allotment Act. In Crooked Paths to Allotment, C. Joseph Genetin-Pilawa complicates these narratives, focusing on political moments when viable alternatives to federal assimilation policies arose. In these moments, Native American reformers and their white allies challenged coercive practices and offered visions for policies that might have allowed Indigenous nations to adapt at their own pace and on their own terms. Examining the contests over Indian policy from Reconstruction through the Gilded Age, Genetin-Pilawa reveals the contingent state of American settler colonialism. Genetin-Pilawa focuses on reformers and activists, including Tonawanda Seneca Ely S. Parker and Council Fire editor Thomas A. Bland, whose contributions to Indian policy debates have heretofore been underappreciated. He reveals how these men and their allies opposed such policies as forced land allotment, the elimination of traditional cultural practices, mandatory boarding school education for Indian youth, and compulsory participation in the market economy. Although the mainstream supporters of assimilation successfully repressed these efforts, the ideas and policy frameworks they espoused established a tradition of dissent against disruptive colonial governance.

Описание: Across Latin America, indigenous women are organizing to challenge racial, gender, and class discrimination through the courts. Collectively, by engaging with various forms of law, they are forging new definitions of what justice and security mean within their own contexts and struggles. They have challenged racism and the exclusion of indigenous people in national reforms, but also have challenged ‘bad customs’ and gender ideologies that exclude women within their own communities.   Featuring chapters on Bolivia, Colombia, Ecuador, Guatemala, and Mexico, the contributors to Demanding Justice and Security include both leading researchers and community activists. From Kichwa women in Ecuador lobbying for the inclusion of specific clauses in the national constitution that guarantee their rights to equality and protection within indigenous community law, to Me’phaa women from Guerrero, Mexico, battling to secure justice within the Inter-American Court of Human Rights for violations committed in the context of militarizing their home state, this book is a must-have for anyone who wants to understand the struggle of indigenous women in Latin America.
