Описание: This book investigates the limits of the legitimate role of the state in regulating the human body. It questions whether there is a public interest in issues of bodily autonomy, with particular focus on reproductive choices, end of life choices, sexual autonomy, body modifications and selling the body. The main question addressed in this book is whether such autonomous choices about the human body are, and should be, subject to state regulation. Potential justifications for the state’s intervention into these issues through mechanisms such as the criminal law and regulatory schemes are evaluated. These include preventing harm to others and/or to the individual involved, as well as more abstract concepts such as public morality, the sanctity of human life, and the protection of human dignity. The State and the Body argues that the state should be particularly wary about encroaching upon exercises of autonomy by embodied selves and concludes that only interventions based upon Mill’s harm principle or, in tightly confined circumstances, the dignity of the human species as a whole should suffice to justify public intervention into private choices about the body.

Описание: Husak`s primary goal is to defend a set of constraints to limit the authority of states to enact and enforce criminal offenses. In addition, Husak situates this endeavor in criminal theory as traditionally construed. This book urges the importance of this topic in the real world, while most Anglo-American legal philosophers have neglected it.

Описание: How does the state, as a public authority, relate to those under its jurisdiction through the criminal law? Connecting the ways in which criminal lawyers and public lawyers address questions of criminal law's legitimacy, contributors to this collection explore issues such as criminal law-making and jurisdiction; the use of criminal law to suppress challenges to state authority; the purposes and mechanisms of state punishment; the value of coherence in legal systems; the interface between tort and crime; and the importance of doctrinal guidance in the application of criminal law. Overall, the collection aims to enhance and deepen our understanding of criminal law by conceiving of the practices of criminal justice as explicitly and distinctly embedded in the project of liberal self-governance. Описание: Engaging with contemporary literature on criminal law, prevention, risk, security, and criminalisation, this volume argues that the pervasiveness of prevention in 21st century criminal justice systems represents the manifestation of essential aspects of the liberal legal and political tradition.
Felony conviction and mass incarceration attract considerable media attention these days, yet the most common criminal-justice encounters are for misdemeanors, not felonies, and the most common outcome is not prison. In the early 1990s, New York City launched an initiative under the banner of Broken Windows policing to dramatically expand enforcement against low-level offenses. Misdemeanorland is the first book to document the fates of the hundreds of thousands of people hauled into lower criminal courts as part of this policing experiment.
Drawing on three years of fieldwork inside and outside of the courtroom, in-depth interviews, and analysis of trends in arrests and dispositions of misdemeanors going back three decades, Issa Kohler-Hausmann argues that lower courts have largely abandoned the adjudicative model of criminal law administration in which questions of factual guilt and legal punishment drive case outcomes. Due to the sheer volume of arrests, lower courts have adopted a managerial model--and the implications are troubling. Kohler-Hausmann shows how significant volumes of people are marked, tested, and subjected to surveillance and control even though about half the cases result in some form of legal dismissal. She describes in harrowing detail how the reach of America's penal state extends well beyond the shocking numbers of people incarcerated in prisons or stigmatized by a felony conviction.
Compelling and innovative, Misdemeanorland shows how the lower reaches of our criminal justice system operate as a form of social control and surveillance, often without adjudicating cases or imposing formal punishment.

Описание:
What does it mean to trust the police? What makes the police legitimate in the eyes of the policed? What builds trust, legitimacy and cooperation, and what undermines the bond between police and the public? These questions are central to current debates concerning the relationship between the British police and the public it serves. Yet, in the context of British policing they are seldom asked explicitly, still less examined in depth.
Drawing on psychological and sociological explanatory paradigms, Just Authority? presents a cutting-edge empirical study into public trust, police legitimacy, and people's readiness to cooperate with officers. It represents, first, the most detailed test to date of Tom Tyler's procedural justice model attempted outside the United States. Second, it uncovers the social ecology of trust and legitimacy and, third, it describes the relationships between trust, legitimacy and cooperation.
This book contains many important lessons for practitioners, policy-makers and academics. As elsewhere the dominant vision of policing in Great Britain continues to stress instrumental effectiveness: the 'fight against crime' will be won by pro-active and even aggressive policing. In line with work from the United States and elsewhere, Just Authority? casts significant doubt on such claims. When people find policing to be unfair, disrespectful and careless of human dignity, not only is trust lost, legitimacy is also damaged and cooperation is withdrawn as a result. Absent such public support, the job of the police is made harder and the avowed objectives of less crime and disorder placed ever further from reach.
