Описание: This volume in the Swedish Studies in European Law series, produced by the Swedish Network for European Legal Studies, heralds the new harmonised regime of private enforcement of EU competition law. In 2013, the Commission issued a Communication and Practical Guide to the quantification of harm in antitrust litigation and a Recommendation on collective redress. In 2014, the long-awaited Directive on actions for damages for infringements of EU competition law was finally adopted. In 2016, the Commission is expected to issue guidelines on the passing-on of overcharges. This book examines these recent developments and offers the perspectives of judges, officials, practitioners and academics. With a preface by Judge Carl Wetter of the General Court, the book explores five different themes. In section one, the main policy issues and challenges are presented. In section two, the new regime is placed in the bigger picture of recent EU law developments. In section three, the nexus between private enforcement and transparency is investigated. A comparative perspective is offered in section four by looking into private enforcement in five Member State jurisdictions. Finally, issues relating to causation, harm and indirect purchasers are explored in section five.

Описание: This book analyses the Habitats Directive; one of the most prominent piece of EU environmental legislation of the past decades. Seen by some as the cornerstone of Europe’s nature conservation policy, among other measures the Directive established the so-called "Natura 2000" ecological network, which covers more than 18% of the surface of the EU. However, despite the fact the Directive was adopted over twenty years ago only 17% of the protected habitats and species in Europe are being adequately protected while 10-60 % of animal species remain under threat. In light of the limited success and the contested nature of the Habitats Directive so far this book examines the successes and failures of the Habitats Directive from a legal and political angle. The book brings together international experts to consider the application, implementation and future of the Habitats Directive in order to assess whether the Habitats Directive is resilient enough to tackle biodiversity loss in the twenty- first century. Despite increasing racial tolerance and national diversity, neighborhood segregation remains a very real problem in cities across America. Scholars, government officials, and the general public have long attempted to understand why segregation persists despite efforts to combat it, traditionally focusing on the issue of “white flight,” or the idea that white residents will move to other areas if their neighborhood becomes integrated. In Hate Thy Neighbor, Jeannine Bell expands upon these understandings by investigating a little-examined but surprisingly prevalent problem of “move-in violence:” the anti-integration violence directed by white residents at minorities who move into their neighborhoods. Apprehensive about their new neighbors and worried about declining property values, these residents resort to extra-legal violence and intimidation tactics, often using vandalism and verbal harassment to combat what they view as a violation of their territory.
Hate Thy Neighbor is the first work to seriously examine the role violence plays in maintaining housing segregation, illustrating how intimidation and fear are employed to force minorities back into separate neighborhoods and prevent meaningful integration. Race is a political construction. A political construction is something created by people; that is not a natural development; is constructed or created for a political purpose. The concept of race was created as a classification of human beings to give power to white people and to legitimize the dominance of white people over non-white people.
