It discusses to what extent the Convention is capable of dealing with claims from children given the two competing ideologies - the child as a vulnerable object in law to be protected and the child as a subject with rights.

A gift of truth for a generation of Dreamers, a vault of memories for their parents, and a record of shame, pride, sorrow, humor, and forgotten fact for a nation of immigrants.
One comes away from Human Rights and Wrongs knowing more about motivation, fear, risk-taking, and problem solving than when one began. But more than that, one knows more about the conditions of oppression that force people from all over--Central America, the Caribbean, the Middle East, North Africa--to flee their countries, and the conditions of human support and solidarity that help them rebuild shattered lives.
A broken immigration system that leaves a child in Arizona without parents and a man in El Salvador without children may make one cry. But there's much to celebrate, too, like positive outcomes in asylum hearings, the beauty of volunteer efforts that ransom a student out of immigration detention, the helicopter rescue of a writer lost in the woods.
Dr. Aron's book is both instructive and uplifting, and a fierce rebuke to anti-immigrant voices booming across our spacious skies.

Описание: | 2017 SUNSHOT BOOK PRIZE | A gift of truth for a generation of Dreamers, a vault of memories for their parents, and a record of shame, pride, sorrow, humor, and forgotten fact for a nation of immigrants. Dr. Aron`s book is both instructive and uplifting, and a fierce rebuke to anti-immigrant voices booming across our spacious skies.
This book theorises and concretises the idea of 'absolute rights' in human rights law with a focus on Article 3 of the European Convention on Human Rights (ECHR). It unpacks how we might understand what an 'absolute right' in human rights law is and draws out how such a right's delimitation may remain faithful to its absolute character. Concretising these starting points, it considers how, as a matter of principle, the right not to be subjected to torture or inhuman or degrading treatment or punishment enshrined in Article 3 ECHR is and ought to be substantively delimited by the European Court of Human Rights (ECtHR). Focusing on the wrongs at issue, this analysis touches both on the core of the right and on what some might consider to lie at the right's 'fringes': from the aggravated wrong of torture, to the severity assessment delineating inhumanity and degradation; the justified use of force and its implications for absoluteness; the delimitation of positive obligations to protect from ill-treatment; and the duty not to expel persons to places where they face a real risk of torture, inhumanity or degradation.
Few legal standards carry the simultaneous significance and contestation surrounding this right. This book seeks to contribute fruitfully to efforts to counter a proliferation of attempts to dispute, circumvent or dilute the absolute character of the right not to be subjected to torture or inhuman or degrading treatment or punishment, and offer the groundwork for transparently and coherently (re)interpreting the right's contours in line with its absolute character.

Описание: Understanding Chinese refugee law is difficult for those outside China or unfamiliar with it due to the complex factors involved. Chinese Refugee Law offers a comprehensive, up-to-date, and readily accessible reference to Chinese refugee law. It focuses first on existing laws and practices relating to refugees in China, then offering a scholar's proposal for a law to handle with refugee affairs and implement the Convention Relating to the Status of Refugees . The book provides the detail, insight and background information needed to understand this complex area of law. It examines both existing Chinese statutes and relevant international documents, drawing on and comparing Chinese and English language sources. It is thus an invaluable resource for both Chinese and non-Chinese readers alike.

Описание:
The international refugee regime is fundamentally broken. Designed in the wake of World War II to provide protection and assistance, the system is unable to address the record numbers of persons displaced by conflict and violence today. States have put up fences and adopted policies to deny, deter, and detain asylum seekers. People recognized as refugees are routinely denied rights guaranteed by international law. The results are dismal for the millions of refugees around the world who are left with slender prospects to rebuild their lives or contribute to host communities. T. Alexander Aleinikoff and Leah Zamore lay bare the underlying global crisis of responsibility.
The Arc of Protection adopts a revisionist and critical perspective that examines the original premises of the international refugee regime. Aleinikoff and Zamore identify compromises at the founding of the system that attempted to balance humanitarian ideals with developmental aims and sovereign control of their borders by states. This book offers a way out of the current international morass through refocusing on responsibility-sharing, seeing the humanitarian-development divide in a new light, and putting refugee rights front and center.
Описание: This book provides an explanation for the fundamental disagreement pertaining to immigration and asylum in Europe.
