Описание: From 1953 to 1969, the Supreme Court under Chief Justice Earl Warren brought about many of the proudest achievements of American constitutional law. The Warren declared racial segregation and laws forbidding interracial marriage to be unconstitutional; it expanded the right of citizens to
criticize public officials; it held school prayer unconstitutional; and it ruled that people accused of a crime must be given a lawyer even if they cant afford one. Yet, despite those and other achievements, conservative critics have fiercely accused the justices of the Warren Court of abusing
their authority by supposedly imposing their own opinions on the nation.

As the eminent legal scholars Geoffrey R. Stone and David A. Strauss demonstrate in Democracy and Equality, the Warren Courts approach to the Constitution was consistent with the most basic values of our Constitution and with the most fundamental responsibilities of our judiciary. Stone and Strauss
describe the Warren Courts extraordinary achievements by reviewing its jurisprudence across a range of issues addressing our nations commitment to the values of democracy and equality. In each chapter, they tell the story of a critical decision, exploring the historical and legal context of each
case, the Courts reasoning, and how the justices of the Warren Court fulfilled the Courts most important responsibilities.

This powerfully argued evaluation of the Warren Courts legacy, in commemoration of the 50th anniversary of the end of the Warren Court, both celebrates and defends the Warren Courts achievements against almost sixty-five years of unrelenting and unwarranted attacks by conservatives. It
demonstrates not only why the Warren Courts approach to constitutional interpretation was correct and admirable, but also why the approach of the Warren Court was far superior to that of the increasingly conservative justices who have dominated the Supreme Court over the past half-century.

This book provides a thorough analysis of those claims, introducing the theory of deliberative capacity and its implications for institutional design.

Описание: Constitutional Orphan explores the role of the former suffragists in the emergence of a limited conception of the Nineteenth Amendment, that the Nineteenth was simply a rule preventing states from discriminating against women at the ballot box. The book describes new legal scholarship, which suggests how the Nineteenth can be used more robustly to fully secure gender equality today.

Описание:

Is the world facing a serious threat to the protection of constitutional democracy?

There is a genuine debate about the meaning of the various political events that have, for many scholars and observers, generated a feeling of deep foreboding about our collective futures all over the world. Do these events represent simply the normal ebb and flow of political possibilities, or do they instead portend a more permanent move away from constitutional democracy that had been thought triumphant after the demise of the Soviet Union in 1989?

Constitutional Democracy in Crisis? addresses these questions head-on: Are the forces weakening constitutional democracy around the world general or nation-specific? Why have some major democracies seemingly not experienced these problems? How can we as scholars and citizens think clearly about the ideas of "constitutional crisis" or "constitutional degeneration"? What are the impacts of forces such as globalization, immigration, income inequality, populism, nationalism, religious sectarianism?

Bringing together leading scholars to engage critically with the crises facing constitutional democracies in the 21st century, these essays diagnose the causes of the present afflictions in regimes, regions, and across the globe, believing at this stage that diagnosis is of central importance - as Abraham Lincoln said in his "House Divided" speech, "If we could first know where we are, and whither we are tending, we could then better judge what to do, and how to do it."

Описание:

Asked if the country was governed by a republic or a monarchy, Benjamin Franklin replied, "A republic, if you can keep it."

Since its founding, Americans have worked hard to nurture and protect their hard-won democracy. And yet few consider the role of constitutional law in America's survival. In Unfit for Democracy, Stephen Gottlieb argues that constitutional law without a focus on the future of democratic government is incoherent--illogical and contradictory. Approaching the decisions of the Roberts Court from political science, historical, comparative, and legal perspectives, Gottlieb highlights the dangers the court presents by neglecting to interpret the law with an eye towards preserving democracy.

A senior scholar of constitutional law, Gottlieb brings a pioneering will to his theoretical and comparative criticism of the Roberts Court. The Roberts Court decisions are not examined in a vacuum but instead viewed in light of constitutional politics in India, South Africa, emerging Eastern European nations, and others. While constitutional decisions abroad have contributed to both the breakdown and strengthening of democratic politics, decisions in the Roberts Court have aggravated the potential destabilizing factors in democratic governments. Ultimately, Unfit for Democracy calls for an interpretation of the Constitution that takes the future of democracy seriously. Gottlieb warns that the Roberts Court's decisions have hurt ordinary Americans economically, politically, and in the criminal process. They have damaged the historic American melting pot, increased the risk of anti-democratic paramilitaries, and clouded the democratic future.
