Описание: When we think of sex--good sex, bad sex, sexual assault, rape law, or university sexual misconduct policies--we so often turn to consent as both our moral and erotic savior. What counts as sexual consent? How can we make consent sexy? How do we teach consent to impressionable youth, potential predators, and victims alike?
What if these are all the wrong questions?
Screw Consent is a provocative take on consent and whether its place at the center of sexual politics and sex law is warranted. The book takes aim at sex imagined at the center of our moral universe: adult, coupled, consensual. By spotlighting sex on the periphery--bestial, necrophilic, kinky, cannibalistic--Screw Consent shows that sex on the margins confounds the ethical force of consent much further than we anticipate. Author Joseph J. Fischel fervently argues that the consent paradigm of sexual politics is profoundly flawed. In addition to the criticisms against consent leveled by feminist theorists of earlier generations, Fischel elevates three more: consent is insufficient, inapposite, and riddled with scope contradictions for regulating and imagining sex. We can do so much better than consent in our sexual politics.
Fischel contends that sexual justice turns more productively on concepts of autonomy and access rather than consent. Cleverly humorous and adeptly researched, Screw Consent will have a significant impact on how we understand consent, sexuality, and law in the U.S. today.
The goal of this book is to shed psychoanalytic light on a concept—informed consent—that has transformed the delivery of health care in the United States. Examining the concept of informed consent in the context of psychoanalysis, the book first summarizes the law and literature on this topic. Is informed consent required as a matter of positive law? Apart from statutes and cases, what do the professional organizations say about this? Second, the book looks at informed consent as a theoretical matter. It addresses such questions as: What would be the elements of a robust informed consent in psychoanalysis? Is informed consent even possible here? Can patients really understand, say, transference or regression before they experience them, and is it too late once they have? Is informed consent therapeutic or countertherapeutic? Can a “process view” of informed consent make sense here? Third, the book reviews data on the topic. A lengthy questionnaire answered by sixty-two analysts reveals their practices in this regard. Do they obtain a statement of informed consent from their patients? What do they disclose? Why do they disclose it? Do they think it is possible to obtain informed consent in psychoanalysis at all? Do they think the practice is therapeutic or countertherapeutic, and in what ways? Do they think there should or should not be an informed consent requirement for psychoanalysis? The book should appeal above all to therapists interested in the ethical dimensions of their practice.

Описание:
This important book proposes revising the current informed consent protocol for predictive genetic testing to reflect the trend toward patient-centered medicine. Emphasizing the predictive aspect of testing, the author analyzes the state of informed consent procedure in terms of three components: comprehension of risk assessment, disclosure to select appropriate treatment, and voluntariness. The book's revised model revisits these cornerstones, restructuring the consent process to allow for expanded comprehension time, enhanced patient safety, greater patient involvement and autonomy, and reduced chance of coercion by family or others. A comparison of the current and revised versions and case studies showing the new model in real-world applications add extra usefulness to this resource.
Included in the coverage:
The science behind PGT.
Understanding genetic risks and probability.
The history of informed consent.
Revised model of informed consent: comprehension, disclosure, voluntariness, patient safety.
Applications of the model in DTC and pleiotropic genetic testing.
Implementation of the revised model, and assessing its effectiveness.
A milestone in the bioethics literature, Informed Consent in Predictive Genetic Testing will be of considerable interest to genetic counselors, medical and bioethicists, and public health professionals.

Описание:
An introduction to issues of sexual consent, covering key strands of feminist thought, how sexual consent is negotiated in practice, the influence of popular culture, and more.
The #MeToo movement has focused public attention on the issue of sexual consent. People of all genders, from all walks of life, have stepped forward to tell their stories of sexual harassment and violation. In a predictable backlash, others have taken to mass media to inquire plaintively if "flirting" is now forbidden. This volume in the MIT Press Essential Knowledge series offers a nuanced introduction to sexual consent by a writer who is both a scholar and an activist on this issue.
It has become clear from discussions of the recent high-profile cases of Harvey Weinstein, Bill Cosby, and others that there is no clear agreement over what constitutes consent or non-consent and how they are expressed and perceived in sexual situations. This book presents key strands of feminist thought on the subject of sexual consent from across academic and activist communities and covers the history of research on consent in such fields as psychology and feminist legal studies. It discusses how sexual consent is negotiated in practice, from "No means no" to "Yes means yes," and describes what factors might limit individual agency in such negotiations. It examines how popular culture, including pornography, romance fiction, and sex advice manuals, shapes our ideas of consent; explores the communities at the forefront of consent activism; and considers what meaningful social change in this area might look like. Going beyond the conventional cisgender, heterosexual norm, the book lists additional resources for those seeking to improve their practice of consent, survivors of sexual violence, and readers who want to understand contemporary debates on this issue in more depth.

Описание:
Psychoanalytic Method in Motion identifies and examines varied controversies about how psychoanalysts believe treatment should best be conducted. Irrespective of their particular school of thought, every analyst builds up a repertoire of his favored ways of working, which some analysts come to see as the most efficacious approach to treatment available. While such differences of opinion are unsettling, and may even threaten to tear the field asunder, this book sees these differences as benefitting psychoanalysis by improving the ways in which psychoanalysts and psychoanalytic psychotherapists practice.
In this book, Richard Tuch covers the waterfront by examining controversies that further the field by raising questions that help evolve the treatment, challenging every analyst to re-think what they are doing in the consulting room...and why. Some of the chief controversies explored include:
the enactment debate--unparalleled tool or regrettable error?
whether analysts can truly be "objective"--whatever that means
the advantages and disadvantages arising from the analyst's use of authority
the ways in which theory influences the analyst's search for data--blinding him to evidence he implicitly discards as irrelevant
whether any given treatment approach is more efficacious than others, as some analysts claim
the legitimacy of psychoanalysis itself--whether it can truly be considered scientific
whether certain methods of supervision are more effective than others
whether free association can be considered therapeutic in and of itself
the extent to which an analyst preferred clinical theory is a product of his personality
Drawing on ideas from a range of different analytic perspectives, this book is an essential and accessibly written guide to working towards best practice in the analytic setting. Psychoanalytic Method in Motion will appeal greatly to both students and practitioners of psychoanalysis and psychoanalytic psychotherapy.
