Angesichts der unterschiedlich ausgepr gten Rechtspositionen ist es f r einen Gl ubiger von entscheidender Bedeutung, welcher Kategorie er zugeordnet wird. Nicht selten ist diese Fragestellung daher Gegenstand entsprechender Auseinandersetzungen. Der Autor liefert eine systematische Untersuchung der in den 38 ff.
