Black Gold and Blackmail seeks to explain why great powers adopt such different strategies to protect their oil access from politically motivated disruptions. In extreme cases, such as Imperial Japan in 1941, great powers fought wars to grab oil territory in anticipation of a potential embargo by the Allies; in other instances, such as Germany in the early Nazi period, states chose relatively subdued measures like oil alliances or domestic policies to conserve oil. What accounts for this variation? Fundamentally, it is puzzling that great powers fear oil coercion at all because the global market makes oil sanctions very difficult to enforce.
Rosemary A. Kelanic argues that two variables determine what strategy a great power will adopt: the petroleum deficit, which measures how much oil the state produces domestically compared to what it needs for its strategic objectives; and disruptibility, which estimates the susceptibility of a state's oil imports to military interdiction--that is, blockade. Because global markets undercut the effectiveness of oil sanctions, blockade is in practice the only true threat to great power oil access. That, combined with the devastating consequences of oil deprivation to a state's military power, explains why states fear oil coercion deeply despite the adaptive functions of the market.
Together, these two variables predict a state's coercive vulnerability, which determines how willing the state will be to accept the costs and risks attendant on various potential strategies. Only those great powers with large deficits and highly disruptible imports will adopt the most extreme strategy: direct control of oil through territorial conquest.

Описание: Asia has witnessed a proliferation of free trade agreements (FTAs) since the turn of the millennium. The first regional agreement — the ASEAN FTA — was transformed into the ASEAN Economic Community at the end of 2015. In the meantime, ASEAN forged five ASEAN 1 FTAs and began to negotiate a sixteen-member Regional Comprehensive Economic Partnership (RCEP) Agreement. In parallel, the U.S.-led Trans-Pacific Partnership (TPP), supporting U.S. foreign policy of ""Pivot to Asia"", was broadly agreed in October 2015. The RCEP and the TPP are accompanied by other mega-regional integration processes developing elsewhere in the world, including the Transatlantic Trade and Investment Partnership for the European Union and the United States, and the Pacific Alliance among four Latin American member states. Meanwhile, APEC is also striving to meet its Bogor Goal targets and create a Free Trade Area of the Asia-Pacific.Each of these mega-regionals aims to achieve greater trade and investment liberalization and facilitation and more harmonized trade and investment rules so that all member economies can participate in the global value chain of production. Описание: The pulling out of the Trans-Pacific Partnership (TPP) by the US marks a new era for trade deals and potentially for intellectual property (IP). The TPP has evolved to become the Comprehensive and Progressive Agreement for TPP (CPTPP) with the remaining 11 members suspending some of its provisions, over half of which are IP-related. While the TPP excludes the two Asian giants - India and the People's Republic of China (PRC) - the ongoing Regional Comprehensive Economic Partnership (RCEP) negotiations include both of them.
The first part of this edited collection sets out to re-examine some basic principles of trade negotiation, such as choosing the right representatives to negotiate and enhancing transparency as a cure to the public's distrust against trade talks; moreover, it analyses how CPTPP might impact on RCEP's IP chapter and examines the possible norm setters of Asian IP. It then focuses on the PRC's trade and IP strategy against the backdrop of the power games between the PRC, India and the US.
The second part of the book reflects on issues related to investor-state dispute settlement and its relationship with IP, such as how to re-calibrate the balance in international investment arbitration, and whether compulsory license of IP constitutes expropriation in India, the PRC and select ASEAN countries.
