Описание: My Father and Atticus Finch is the true story of Foster Beck, the author’s late father, whose courageous defense of a black man accused of raping a white woman in 1930s Alabama foreshadowed the trial at the heart of Harper Lee’s classic novel To Kill a Mockingbird. After repeatedly being told that his father’s case “might have” inspired Ms. Lee, author Beck, now a lawyer himself, located the trial transcript and multiple newspaper articles and here reconstructs his father’s role in State of Alabama v. Charles White, Alias. On the day of the arrest, the local newspaper reported, under a page-one headline, that “a wandering negro fortune teller giving the name Charles White” had “volunteered a detailed confession of the attack” of a local white girl. However, Foster Beck concluded that the confession was coerced. The same article claimed that “the negro accomplished his dastardly purpose,” but as in To Kill a Mockingbird, there was stunning and dramatic testimony at the trial to the contrary. The saga captivated the community with its dramatic testimonies and emotional outcome. This riveting memoir, steeped in time and place, seeks to understand how race relations, class, and the memory of southern defeat in the Civil War produced such a haunting distortion of justice and how it may figure into our literary imagination.

Описание: Through redrafting the judgments of the European Court of Human Rights, international scholars demonstrate how these judgments could improve the mainstreaming of diversity. Considering six groups - women, children, LGB persons, ethnic and religious minorities, and persons with disabilities - this book demonstrates how academic analysis can translate into judicial practice.
Описание: Religious courts have been part of the European legal landscape for centuries. Almost all churches and religious communities have their own judicial systems, often composed of courts or tribunals ordered hierarchically. The aim of this book is to present cases from the jurisprudence of the European Court of Human Rights, in which a religious court was involved at the stage of domestic proceedings. The twelve cases in question originate from a number of European States, in which the applicants belonged to many denominations, although predominantly Christian. The Court of Human Rights has mainly been concerned with religious courts in terms of compliance with the requirement for a fair hearing by an independent and impartial tribunal under Article 6 of the European Convention of Human Rights and has come to various conclusions. The most recent judgment from September 2017, Nagy v. Hungary, and in particular many associated dissenting opinions, demonstrate that the matter is worthy of study, particularly in the contemporary context of religious freedom.
Описание: A right to equality and non-discrimination is widely seen as fundamental in democratic legal systems. But failure to identify the human interest that equality aims to uphold reinforces the argument of those who attack it as morally empty or unsubstantiated and weakens its status as a fundamental human right. This book argues that an understanding of the human interest which equality aims to uphold is feasible within the jurisprudence of the European Court of Human Rights (ECtHR) and the European Court of Justice (ECJ). In comparing the evolution of the prohibition of discrimination in the case-law of both Courts, Charilaos Nikolaidis demonstrates that conceptual convergence within the European Convention on Human Rights (ECHR) and the EU on the issue of equality is not as far as it might appear initially. While the two bodies of equality law are extremely divergent as to the requirements they impose, their interpretation by the international judiciary might be properly analysed under a common light to emphasise the substantive dimension of equality in European Human Rights law. The book will be of great use and interest to scholars and students of human rights, discrimination law, and European politics.

Автор: Elizabeth Wicks Название: The State and the Body: Legal Regulation of Bodily Autonomy ISBN: 184946779X ISBN-13(EAN): 9781849467797 Издательство: Bloomsbury Academic Рейтинг: Цена: 13464.00 р. Наличие на складе: Есть у поставщика Поставка под заказ.
Описание: This book investigates the limits of the legitimate role of the state in regulating the human body. It questions whether there is a public interest in issues of bodily autonomy, with particular focus on reproductive choices, end of life choices, sexual autonomy, body modifications and selling the body. The main question addressed in this book is whether such autonomous choices about the human body are, and should be, subject to state regulation. Potential justifications for the state’s intervention into these issues through mechanisms such as the criminal law and regulatory schemes are evaluated. These include preventing harm to others and/or to the individual involved, as well as more abstract concepts such as public morality, the sanctity of human life, and the protection of human dignity. The State and the Body argues that the state should be particularly wary about encroaching upon exercises of autonomy by embodied selves and concludes that only interventions based upon Mill’s harm principle or, in tightly confined circumstances, the dignity of the human species as a whole should suffice to justify public intervention into private choices about the body.
