Описание: This collection of essays challenge claims that all inquiry must use either the empirical methods of scientific inquiry or the interpretive methods of the humanities. They argue that practical judgement is essential in all forms of inquiry, and aims to shape, rather than to describe or predict, the way things are.

Описание: Law’s Judgement elucidates and defends a feature of contemporary law that is currently either overlooked or too glibly dismissed as morally troublesome or historically anachronistic. That feature is the abstract nature of law’s judgement and its three components show that, when law judges us, it often does so in ignorance of our particular characters and abilities, on the one hand, and in ignorance of our context and circumstances, on the other. Law’s judgement is thus insensitive to all or much that makes us the particular people we are. The book explores various connections between this mode of judgement and some of our most important legal and political values. It shows that law’s abstract judgement is closely related to important juristic conceptions of personhood, responsibility and impartiality, and that these notions are not without moral significance. The book also examines the connections between modern law’s judgement and three of our most important political values, namely, dignity, equality and community. It argues that, if we value particular conceptions of dignity, equality and community, then we must also value law’s judgement. Illuminating these connections therefore serves a double purpose: first, it makes a case against those who counsel liberation from law’s abstract judgement and, second, it redirects attention to the task of morally evaluating law’s abstract judgement in its own terms.

Описание: How many times do we hear the statement ‘It’s not for me to judge’? It conveys one of the most popular ideas of our time: that to make judgements of others is essentially wrong. In this classic text, the renowned moral philosopher Mary Midgely turns a spotlight on the ever popular stance in society that we should not make moral judgements on others. Guiding the reader through the diverse approaches to this complex subject, she interrogates our strong beliefs about such things as the value of freedom that underlie our scepticism about making moral judgements. She shows how the question of whether or not we can make these judgements must inevitably affect our attitudes not only to the law and its institutions but also to events that occur in our daily lives, and suggests that mistrust of moral judgements may be making life even harder for us than it would be otherwise. The texts and philosophers discussed range from Nietzsche and Sartre to P.D. James and the Bhagavad Gita. The Bloomsbury Revelations edition includes a new preface from the author.

Описание:
This book examines the nature of totalitarianism as interpreted by some of the finest minds of the twentieth century. It focuses on Hannah Arendt's claim that totalitarianism was an entirely unprecedented regime and that the social sciences had integrally misconstrued it. A sociologist who is a critical admirer of Arendt, Baehr looks sympathetically at Arendt's objections to social science and shows that her complaints were in many respects justified.
Avoiding broad disciplinary endorsements or dismissals, Baehr reconstructs the theoretical and political stakes of Arendt's encounters with prominent social scientists such as David Riesman, Raymond Aron, and Jules Monnerot. In presenting the first systematic appraisal of Arendt's critique of the social sciences, Baehr examines what it means to see an event as unprecedented. Furthermore, he adapts Arendt and Aron's philosophies to shed light on modern Islamist terrorism and to ask whether it should be categorized alongside Stalinism and National Socialism as totalitarian.
