Описание: This book constitutes Volume I of a set of two Volumes. Volume I attempts a holistic inter-disciplinary evaluation of the legitimacy of colonial and emergent post-colonial rule property rights in affected States of the Southern African Development Community (SADC) in light of intensifying litigation in national courts, the SADC Tribunal, and more recently the Washington based International Centre for the Settlement of Investment Disputes (ICSID) regarding counter claims to title to property. Cultural, economic and political drivers at the core of SADC land issues are examined for their significance and potential to contribute to the discovery of a new, sustainable land relations policy that guarantees social justice in the distribution of all the advantages and disadvantages relating to the allocation and use of land. The book shows that persistent systematic administrative failures by pre-colonial, colonial and post-colonial authorities have made for a very complex challenge that requires Solomonic tools that neither the Courts alone, nor human rights centric morality alone could resolutely attend. Therefore, the book recommends a sophisticated systematic new approach to SADC land issues. That approach is developed in Volume II of this series: Re-conceiving Property Rights in the new millennium - Towards a New Sustainable Land Relations Policy.
Situations of serious or massive violations of human rights are no longer purely of domestic concern, and sovereignty can no longer be an absolute shield for repressive governments in such circumstances. Based on this realization, the international community has recognized a responsibility to protect individuals in states where their governments are unable or unwilling to provide protection against the most serious violations. However, so far, only one intergovernmental organization, the African Union (AU), has explicitly made the right to intervene in a Member State part of its foundational text in Article 4(h) of its Constitutive Act. Although there have been cases of Article 4(h)-type interventions in Africa, the AU Assembly has not yet invoked Article 4(h) explicitly.
This book brings together experts in the field to explore the potential application of Article 4(h), and the complexities that may explain its non-invocation so far. Although Article 4(h) is noble in purpose, its implementation faces several legal and policy challenges given that the use of force penetrates the principles of state sovereignty and non-intervention - the very cornerstones upon which the AU is founded. This book considers these issues, as well as the need to reconcile Article 4(h), in so far as it allows the AU to exercise military intervention to protect populations at risk of mass atrocities, with the provisions of the Charter of the United Nations.

As Africa's strategic importance has increased over the past decade and a half, United States security cooperation with the continent has expanded. The most visible dimension of this increased engagement was the establishment of the U.S. Military Command for Africa (AFRICOM). Some critics are skeptical of AFRICOM's purpose and see the militarization of U.S. Africa policy while others question its effectiveness. Recognizing the link between development and security, AFRICOM represents a departure from the traditional organization of military commands because of its holistic approach and the involvement of the Department of State as well as other U.S. government stakeholders. Nevertheless, AFRICOM's effort to combine security and development faces formidable conceptual and operational challenges in trying to ensure both American and African security interests. The human security perspective's emphasis on issues that go beyond traditional state-centered security to include protecting individuals from threats of hunger, disease, crime, environmental degradation, and political repression as well as focusing on social and economic justice is an important component of security policy. At the same time, the threat of violent extremism heavily influences U.S. security cooperation with Africa.
