Much less, however, is known about the everyday workings of immigration law inside borders. Drawing on in-depth ethnographic fieldwork in Italy, one of Europe's biggest receiving countries, Rules, Paper, Status moves away from polarized depictions to reveal how migration processes actually play out on the ground. Anna Tuckett highlights the complex processes of inclusion and exclusion produced through encounters with immigration law.

The statuses of "legal" or "illegal," which media and political accounts use as synonyms for "good" and "bad," "worthy" and "unworthy," are not created by practices of border-crossing, but rather through legal and bureaucratic processes within borders devised by governing states. Taking migrants' interactions with immigration regimes as its starting point, this book sheds light on the productive nature of legal and bureaucratic encounters and the unintended consequences they produce. Rules, Paper, Status argues that successfully navigating Italian immigration bureaucracy, which is situated in an immigration regime that is both exclusionary and flexible, requires and induces culturally specific modes of behavior. Exclusionary laws, however, can transform this social and cultural learning into the very thing that endangers migrants' right to live in the country.

Описание: The debate on the free movement of labour within the EU has gained new momentum in the wake of the economic crisis. Building on the earlier Ashgate publication EU Labour Migration Since Enlargement, the editors have assembled a team of experts from across Europe to shed light on the critical issues raised by internal labour mobility within the EU in the context of economic crisis and labour market pressures. The book's chapters tease out the links between economic developments, regulatory frameworks and migration patterns in different European countries. A central focus is on issues of skills and skills mismatch and how they relate to migration forms, duration and individual decisions to stay or return. Based on detailed analysis of European and national-level sources, the results presented clearly contradict assumptions about a "knowledge driven migration". Rather, over-qualification and the corresponding underutilisation of migrant workers' skills emerge as a pervasive phenomenon. At the same time the characteristics of migrants - not just skills, but socio-demographic characteristics and attitudes - and also their labour market integration are shown to be very diverse and to vary substantially between different sending and receiving countries. This calls for a differentiated analysis and raises complex issues for policymakers. Examples where policy has contributed to positive outcomes for both migrants and domestic workforces are identified. Unique in analysing labour migration flows within the European Union in a comparative manner putting skills into the centre and taking account of the effects of the economic crisis, while addressing policy concerns this is a valuable resource for academics, policymakers and practitioners alike.

The discourse on migration outcomes in the West has largely been dominated by issues of integration, but it is more relevant to view immigration in non-Western societies in relation to practices of exclusion and inclusion. Exclusion refers to a situation in which individuals and groups are usually denied access to the goods, services, activities and resources associated with citizenship. However, this approach has been criticised in relation to gender issues, which are very relevant to the situation of migrants. The authors in this volume address this criticism. Furthermore, when framed within a North–South discourse, it may be potentially ethnocentric to assume that the experience of exclusion is cross-culturally uniform. Indeed, work on migration issues has invariably been conducted within such a discourse. The contributors go beyond this binary discourse of ‘exclusion versus inclusion’ which has dominated migration research. They examine the situation of migrants in the Middle East and Asia as one that encompasses both exclusion and inclusion, addressing related concepts of empowerment, ethnocracy, the feminisation of migration and gendered geographies of power, liberal constraint and multiculturalism, individual agency, migrant-friendly discourses, spaces of emancipation and spaces of insecurity. The book highlights current research in the Arab Gulf states, and examines multiculturalism in Asia more broadly.
