Описание: Mexico's Reforma, the mid-nineteenth-century liberal revolution, decisively shaped the country by disestablishing the Catholic Church, secularizing public affairs, and laying the foundations of a truly national economy and culture. The Lawyer of the Church is an examination of the Mexican clergy's response to the Reforma through a study of the life and works of Bishop Clemente de Jesus Munguia (1810-68), one of the most influential yet least-known figures of the period. By analyzing how Munguia responded to changing political and intellectual scenarios in defense of the clergy's legal prerogatives and social role, Pablo Mijangos y Gonzalez argues that the Catholic Church opposed the liberal revolution not because of its supposed attachment to a bygone past but rather because of its efforts to supersede colonial tradition and refashion itself within a liberal yet confessional state. With an eye on the international influences and dimensions of the Mexican church-state conflict, The Lawyer of the Church also explores how Mexican bishops gradually tightened their relationship with the Holy See and simultaneously managed to incorporate the papacy into their local affairs, thus paving the way for the eventual "Romanization" of Mexican Catholicism during the later decades of the century. Pablo Mijangos y Gonzalez is an assistant professor of history at the Centro de Investigacion y Docencia Economicas (CIDE) in Mexico City. He is the author of a book on Mexico's contemporary legal historiography, published in Spain, and is coeditor of a volume on the origins and transformations of the Spanish American constitutional tradition, published in Mexico."

Описание:

Justice in Plain Sight is the story of a hometown newspaper in Riverside, California, that set out to do its job: tell readers about shocking crimes in their own backyard. But when judges slammed the courtroom door on the public, including the press, it became impossible to tell the whole story. Pinning its hopes on business lawyer Jim Ward, whom Press-Enterprise editor Tim Hays had come to know and trust, the newspaper took two cases to the U.S. Supreme Court in the 1980s. Hays was convinced that the public--including the press--needed to have these rights and needed to bear witness to justice because healing in the aftermath of a horrible crime could not occur without community catharsis. The newspaper won both cases and established First Amendment rights that significantly broadened public access to the judicial system, including the right for the public to witness jury selection and preliminary hearings.

Justice in Plain Sight is a unique story that, for the first time, details two improbable journeys to the Supreme Court in which the stakes were as high as they could possibly be (and still are): the public's trust in its own government.

Dan Bernstein is a retired reporter, editorial writer, and general interest columnist for the Press-Enterprise newspaper in Riverside, California. He has won various state and national awards for column writing and is the author of two children's books.

Описание: Jeremiah Gridley (1702-1767) is considered ""the greatest New England lawyer of his generation,"" yet we know little about him. Most of his renown is a product of the fame of his students, most notably John Adams. Gridley deserves more. He was an active participant in the Writs of Assistance trial and the Stamp Act controversy, and as a leader of the Boston bar, an editor, speculator, legislator, and politician, his life touched and was touched by much that was integral to eighteenth-century Massachusetts. The Last Great Colonial Lawyer presents a portrait of Gridley against the background of his times. Religious controversies enter into this narrative, as do colonial wars and the increasing strains with Great Britain, but Charles R. McKirdy also rescues from the footnotes of time subjects such as the smallpox epidemic of 1721 and the currency crisis of the 1740s. Because Gridley was above all a lawyer, the primary focus is on his cases, which illuminate in a unique and very human way attitudes regarding race, status, commerce, property, and power.

Описание:

In the personal and frank Confessions of a Free Speech Lawyer, Rodney A. Smolla offers an insider's view on the violent confrontations in Charlottesville during the "summer of hate." Blending memoir, courtroom drama, and a consideration of the unhealed wound of racism in our society, he shines a light on the conflict between the value of free speech and the protection of civil rights.

Smolla has spent his career in the thick of these tempestuous and fraught issues, from acting as lead counsel in a famous Supreme Court decision challenging Virginia's law against burning crosses, to serving as co-counsel in a libel suit brought by a fraternity against Rolling Stone magazine for publishing an article alleging that one of the fraternity's initiation rituals included gang rape. Smolla has also been active as a university leader, serving as dean of three law schools and president of one and railing against hate speech and sexual assault on US campuses.

Well before the tiki torches cast their ominous shadows across the nation, the city of Charlottesville sought to relocate the Unite the Right rally; Smolla was approached to represent the alt-right groups. Though he declined, he came to wonder what his history of advocacy had wrought. Feeling unsettlingly complicit, he joined the Charlottesville Task Force, and he realized that the events that transpired there had meaning and resonance far beyond a singular time and place. Why, he wonders, has one of our foundational rights created a land in which such tragic clashes happen all too frequently?
