Описание: This book charts the transformative shifts in techniques that seek to deliver collective redress, especially for mass consumer claims in Europe. It shows how traditional approaches of (class) litigation (old technology) have been eclipsed by the new technology of regulatory redress techniques and consumer ombudsmen. It describes a series of these techniques, each illustrated by leading examples taken from a 2016 pan-EU research project. It then undertakes a comparative evaluation of each technique against key criteria, such as effective outcomes, speed, and cost. The book reveals major transformations in European legal systems, and the overriding need to view legal systems from fresh viewpoints, and to devise a new integrated model. (Civil Justice Systems, Vol. 7)
Описание: Presents research that analyses sexual violence crimes and their implications for the needs of victims in post-conflict justice processes and how these needs can be effectively addressed in order to support the affected community. Topics covered include judicial accountability, victims` rights, and criminal justice.
Описание: All too often in situations of armed conflicts, rape and other acts of sexual violence are used as military tactics. The use of sexual violence as a strategy of war is distinctively destructive and not only leaves victims with significant psychological scars but also tears apart the fabric of families and affected communities. Sexual Violence and Effective Redress for Victims in Post-Conflict Situations: Emerging Research and Opportunities is a collection of innovative research that analyzes these crimes and their implications for the needs of victims in post-conflict justice processes and how these needs can be effectively addressed in order to support the affected community. To conduct this analysis, it explores the distinct aspects of these crimes to understand the nature and extent of the social challenges and damage facing the victim, and examines the challenges and limitations of international criminal justice in dealing with a wide range of victim needs. While highlighting topics including judicial accountability, victims' rights, and criminal justice, this book is ideally designed for psychologists, therapists, government officials, academicians, policymakers, and researchers.

Описание:
The story of the World War II internment of 120,000 Japanese American citizens and Japanese-born permanent residents is well known by now. Less well known is the history of the small group of Seattle activists who gave birth to the national movement for redress. It was they who first conceived of petitioning the U.S. Congress to demand a public apology and monetary compensation for the individuals and the community whose constitutional rights had been violated.
Robert Sadamu Shimabukuro, using hundreds of interviews with people who lived in the internment camps, and with people who initiated the campaign for redress, has constructed a very personal testimony, a monument to these courageous organizers’ determination and deep reverence for justice. Born in Seattle follows these pioneers and their movement over more than two decades, starting in the late 1960s with second-generation Japanese American engineers at the Boeing Company, as they worked with their fellow activists to educate Japanese American communities, legislative bodies, and the broader American public about the need for the U.S. Government to acknowledge and pay for this wartime injustice and to promise that it will never be repeated.

Описание:
In recent decades, the rise in cross-border law violations has harmed numerous victims around the globe. The damages are often dispersed and low-level. As a result, the private enforcement gap has deepened and collective redress represents an interesting procedural instrument that is able to provide effective access to justice.
This book analyses thoroughly the dominant collective redress models adopted in the EU. Data from 13 Member States has been catalogued and categorised. The research mainly focuses on the consumer law field but frequent references to financial and data protection-related cases are made. The dominant collective redress models are then studied from a private international law perspective. In particular, the book highlights the current mismatch between collective redress on the one hand, and rules on international jurisdiction on the other. Additionally, it notes that barriers to cross-border litigation remain significant for victims and their representatives. The unprecedented empirical study included in this book confirms that statement. Observing that EU measures have not satisfactorily lowered those barriers, the author proposes the creation of a new head of jurisdiction for cases of international collective redress. This book will be of interest to private international law scholars, researchers, students, legal practitioners, judges and policy-makers. It is a reference point for those with an interest in cross-border collective redress in particular, and private international law in general.

Описание: Alaskan's are in grave danger. Make Alaska Great again is about making more land and resources available for Alaskan's so that they are not 100% dependent on other states for everything. At the present time if Alaska misses two shipments of food from the lower states people will starve. What if a war or revolution starts in the lower forty-eight States or an EMP from the Sun, or extreme draught due to climate change or Yellowstone Volcano erupting destroys most of the food crops, no food will be shipped to Alaska. We can't depend on Russia for aid. This book is about saving the state from a fate similar to Argentina where the government controls all the resources and sells them and wastes the money creating more government. Alaska's current administration takes in more money per capita than any other state and uses the money to create more government. It needs to build a road to Nome like was planned during WWII to allow citizens access to resources. A ferry system to Russia would boost tourism and trade. We need to give up that childish Cold War and stop pointing nukes at each other. Mutually assured destruction is insane Why keep on spending billions to maintain old junk that probably to rusty to detonate? Ask yourself what are we and our grandchildren going to do after the state destroys all the renewable resources and sells off the rest? Their track record of management of renewable resources speaks for itself...

Описание: This book shows how a political and cultural dynamic of amnesia and truth telling shapes literary constructions of history. Gauthier focuses on the works of Don DeLillo, Toni Morrison, Michelle Cliff, Bharati Mukherjee, and Julie Otsuka.
Описание: This major new work of constitutional theory looks at the relationship between constitutions and markets, and how it affects our understanding of citizenship and rights. It criticises the way in which thinking about markets at the national, European and global levels has deformed the democratic understanding of the constitution.
This book examines the redress movement for the victims of Japanese military sexual slavery in South Korea, Japan, and the U.S. comprehensively. The Japanese military forcefully mobilized about 80,000-200,000 Asian women to Japanese military brothels and forced them into sexual slavery during the Asian-Pacific War (1932-1945). Korean "comfort women" are believed to have been the largest group because of Korea’s colonial status. The redress movement for the victims started in South Korea in the late 1980s. The emergence of Korean "comfort women" to society to tell the truth beginning in 1991 and the discovery of Japanese historical documents, proving the responsibility of the Japanese military for establishing and operating military brothels by a Japanese historian in 1992 accelerated the redress movement for the victims. The movement has received strong support from UN human rights bodies, the U.S. and other Western countries. It has also greatly contributed to raising people’s consciousness of sexual violence against women at war. However, the Japanese government has not made a sincere apology and compensation to the victims to bring justice to the victims.
