Описание: Adrian Stalker sets eviction law in context by providing an outline of the development of Scots law in relation to it, and analysing the complex statutory schemes regulating security of tenure. In particular, he examines the prerequisites for obtaining an order for possession under the Housing (Scotland) Acts 1988 and 2001 and an eviction order under the Private Housing (Tenancies) (Scotland) Act 2016.
Описание: This book studies the recent legacy of basti “evictions” in Delhi—mass clearings of some of the city’s poorest neighborhoods as a way to understand how the urban poor are disenfranchised in the name of “public interest” and, in the case of Delhi, by the very courts meant to empower and protect them. Studying bastis, says Gautam Bhan, provokes six clear lines of inquiry applicable to studies of urbanism across the global south. The first is the long-standing debate over urban informality and illegality: the debate’s impact on conceptions and practices of urban planning, the production of space, and the regulation of value. The second is a set of debates on “good governance,” read through their intersections with ideas of “planned development” within rapidly transforming cities. The third is the political field of urban citizenship and the possibilities of substantive rights and belonging in the city. The fourth is resistance and the ability of a city’s subaltern residents to struggle against exclusion. The two remaining inquiries both cut across and unify the first four. One of these is the role of the judiciary and the relationships between law and urbanism in cities of the global south. The other is the relationship between democracy and inequality in the city. What emerges about Delhi in particular is a multilayered double standard in attention to, and enforcement of, property laws. Rights are lost, citizenship is unequal and differentiated, the promise of development is refused, and poverty and inequality are reproduced and deepened. The task at hand, says Bhan, is not just to explain evictions but also to listen to what they are telling us about “the city that is as well as the city that can be.”

Описание: In present-day South Africa, urban development agendas have inscribed doctrines of desirable and undesirable life in city spaces and the public that uses the space. This book studies the ways in which segregated city spaces, displacement of people from their homes, and criminalization practices are structured and executed. Sara Dehkordi shows that these doctrines are being legitimized and legalized as part of a discursive practice and that the criminalization of lower-class members are part of that practice, not as random policing techniques of individual security forces, but as a technology of power that attends to the body, zooms in on it, screens it, and interrogates it.

Описание: "A Brief Guide to Georgia Evictions" is a plain-English "how-to" guide, written for non-lawyer landlords and lawyers who do not typically specialize in landlord-tenant law. Written by an experienced lawyer with more than a decade of experience in this area of the law as both litigator and mediator, this brief yet information-packed book complements, rather than replaces, the many available legal treatises on the subject. The reader is guided through the entire "dispossessory" (eviction) process in Georgia, beginning with concerns to be addressed before suit is even filed, and continuing throughout all phases of litigation, including trial, mediation, appeals, and the eviction process itself. The book is also liberally sprinkled with practice pointers and helpful hints designed to maximize the landlord's potential for success.
