Описание:
There continues to be a remarkable revival in academic interest in Carl Schmitt's thought within politics and social theory but this is the first book to address his thought from an explicitly legal theoretical perspective. Transcending the prevailing one-sided and purely historical focus on Schmitt's significance for debates that took place in the Weimar Republic 1919-1933, this book addresses the actual and potential significance of Schmitt's thought for controversies within contemporary Anglo-American legal theory that have emerged during the past three decades. These include: the critique of liberal forms of legal positivism; the relative 'indeterminacy' of legal doctrine and the need for an explicitly interpretative approach to its range of meanings, their scope and policy rationale; the centrality of discretion and judicial law-making within the legal process; the important role played by ideological prejudices and assumptions in legal reasoning; the reinterpretation of law as a form of strategically disguised politics; the legal theoretical critique of universalistic approaches to "human" rights and associated liberal-cosmopolitan 'ideologies of humanity, ' including the rhetoric of 'humanitarian intervention'; and the limitations of liberal constitutionalism and liberalism more generally as an approach to law.
In Carl Schmitt: Law as Politics, Ideology and Strategic Myth, the author provides an overview and assessment of Schmitt's thought, as well as a consideration of its relevance for contemporary legal thought and debates.

First published in Italian in 2008 and appearing here in English for the first time, Janus's Gaze is the culmination of Carlo Galli's ongoing critique of the work of Carl Schmitt. Galli argues that Schmitt's main accomplishment, as well as the thread that unifies his oeuvre, is his construction of a genealogy of the modern that explains how modernity's compulsory drive to achieve order is both necessary and impossible. Galli addresses five key problems in Schmitt's thought: his relation to the state, the significance of his concept of political theology, his readings of Machiavelli and Spinoza, his relation to Leo Strauss, and his relevance for contemporary political theory. Galli emphasizes the importance of passing through Schmitt’s thought—and, more important, beyond Schmitt’s thought—if we are to achieve insight into the problems of the global age. Adam Sitze provides an illuminating introduction to Schmitt and Galli's reading of him.

Описание: William Rasch offers a reading of Carl Schmitt that avoids rehashing the controversies of the Weimar era in favour of examining a broader historical context. He examines Schmitt`s notion of political theology, eschewing theocratic intention but taking seriously the `secularization` of patterns of thought derived from Medieval theology.

Описание:
While antiliberal legal theorist Carl Schmitt has long been considered by Europeans to be one of this century’s most significant political philosophers, recent challenges to the fundamental values of liberal democracies have made Schmitt’s writings an unavoidable subject of debate in North America as well. In an effort to advance our understanding not only of Schmitt but of current problems of liberal democracy, David Dyzenhaus presents translations of classic German essays on Schmitt alongside more recent writings by distinguished political theorists and jurists. Neither a defense of nor an attack on Schmitt, Law as Politics offers the first balanced response to his powerful critique of liberalism. One of the major players in the 1920s debates, an outspoken critic of the Versailles Treaty and the Weimar Constitution, and a member of the Nazi party who provided juridical respectability to Hitler’s policies, Schmitt contended that people are a polity only to the extent that they share common enemies. He saw the liberal notion of a peaceful world of universal citizens as a sheer impossibility and attributed the problems of Weimar to liberalism and its inability to cope with pluralism and political conflict. In the decade since his death, Schmitt’s writings have been taken up by both the right and the left and scholars differ greatly in their evaluation of Schmitt’s ideas. Law as Politics thematically organizes in one volume the varying engagements and confrontations with Schmitt’s work and allows scholars to acknowledge—and therefore be in a better position to negotiate—an important paradox inscribed in the very nature of liberal democracy. Law as Politics will interest political philosophers, legal theorists, historians, and anyone interested in Schmitt’s relevance to current discussions of liberalism.

Описание: Has liberalism failed because it has succeeded?
Of the three dominant ideologies of the twentieth century--fascism, communism, and liberalism--only the last remains. This has created a peculiar situation in which liberalism's proponents tend to forget that it is an ideology and not the natural end-state of human political evolution. As Patrick Deneen argues in this provocative book, liberalism is built on a foundation of contradictions: it trumpets equal rights while fostering incomparable material inequality; its legitimacy rests on consent, yet it discourages civic commitments in favor of privatism; and in its pursuit of individual autonomy, it has given rise to the most far-reaching, comprehensive state system in human history. Here, Deneen offers an astringent warning that the centripetal forces now at work on our political culture are not superficial flaws but inherent features of a system whose success is generating its own failure.

Описание: Shatters the common academic myth that neoliberalism is simply free market fundamentalism plus political conservatism
Explains how neoliberalism is a regime of culture and values - far more than political economy
Turns much of today's progressive politics upside down by showing that many of the would-be liberators are really the exploiters: as Marx and Engels declared, the 'ruling ideas' of our era must be unmasked as 'the ideas of the ruling class'
Offers a vision of what might lie beyond neoliberalism
Connects the analysis of neoliberalism to the cultural diagnosis of Friedrich Nietzsche, who declared 'God is dead'
Neoliberalism in recent years has become the operative buzzword among pundits and academics to characterise an increasingly dysfunctional global political economy. It is often - wrongly - identified exclusively with free market fundamentalism and illiberal types of cultural conservatism. Combining penetrating argument and broad-ranging scholarship, Carl Raschke shows what the term really means, how it evolved and why it has been so misunderstood.
Raschke lays out how the present new world disorder, signalled by the election of Trump and Brexit, derives less from the ascendancy of reactionary forces and more from the implosion of the post-Cold War effort to establish a progressive international moral and political order for the cynical benefit of a new cosmopolitan knowledge class, mimicking the so-called civilising mission of 19th-century European colonialists.
