Описание: How should political power be divided within and among national peoples? Is the nineteenth-century theory of the sovereign and unitary State still fit for purpose in the twenty-first century? If not, can federalism provide a viable alternative model? This collection looks at federalism from the perspective of constitutional law. Taking the United Kingdom as a case study, Part One tracks the historical evolution of the ‘Union’ and explores the various expressions of federalism that emerged between the eighteenth and twentieth centuries. Part Two then assesses the experience of sovereignty-sharing with other nations in the context of international cooperation. Drawing on the expertise of the foremost commentators in their field, The United Kingdom and the Federal Idea provides a timely and reflective evaluation of how constitutional authority is being re-ordered within and beyond the United Kingdom.

Описание: “...Leyland has produced a slim guide to the constitution of the United Kingdom that is both highly readable and impressively thorough. It deserves a place on undergraduate reading lists as a precursor to a more theoretical examination, and given a very reasonable price one hopes that many students will feel able to purchase their own copy. They will certainly find it worth their while.” – CJS Knight, The Cambridge Law Journal“...provides an excellent discussion of the legal basis of parliamentary sovereignty…” – Alexandra Kelso, Parliamentary AffairsNo one could have imagined when the last edition of this acclaimed book published in 2016, the constitutional earthquakes that were to follow. Brexit, Miller, three prime ministers: little of the United Kingdom’s constitution was unaffected. This much needed new edition retains its hallmark clarity and coherence, with sufficient detail for the novice to develop an informed view of how the constitution works. Taking a thematic approach, it discusses questions of history, sources and conventions, the role of the Crown, Parliament and the electoral system, government and the executive, the judiciary, and the distribution of power. In addition, it offers analysis of the evolution of the uncodified UK constitution, its strengths and perceived weaknesses, and of modernising reforms. This significantly updated edition provides a topical and contextual outline of the principles, doctrines and institutions that underpin the United Kingdom constitution. Engaging with the central issues in play as the UK enters a new chapter of its constitutional story, it explores Brexit, devolution, the Fixed Term Parliament Act, parliamentary sovereignty, and House of Lords reform.Combining clarity and authority, the author makes sense of a fascinating but sometimes impenetrable subject.
Описание: The Human Rights Act (HRA) of the UK, 1998, unlike systems of parliamentary sovereignty and judicial supremacy, promised a new, 'balanced' model for the protection of rights, which conferred courts with limited power of review over legislation. This book examines the promise of the new model against its performance in practice by comparing judicial review under the HRA to an exemplar of the old model of judicial review, the Indian Constitution. Balanced constitutionalism is not achieved through the legislative rejection of judicial decision-making about rights. Instead, the nature of the remedy under the HRA enables British courts to assert their genuine interpretations of rights in situations in which Indian courts find it difficult to do so.

Описание: Is the U.S. as a country still capable of finding common ground and effective policy responses in the 21st century, or are the dividing lines within U.S. society actually becoming too deep and too wide to bridge, with potentially grave consequences for American social, political as well as economic development? This book discusses important contemporary U.S. wedge issues such as gun rights, racial and economic inequality, the role of the state, the politics of culture, interpretations of history and collective memory, polarization in national politics, and factionalism in domestic and foreign policy. It provides readers with conceptual tools to grasp the complexity of the current processes, policy formation, and political and social change under way in the United States.
During the Cold War, the U.S. built a series of alliances with Asian nations to erect a bulwark against the spread of communism and provide security to the region. Despite pressure to end bilateral alliances in the postCold War world, they persist to this day, even as new multilateral institutions have sprung up around them. The resulting architecture may aggravate rivalries as the U.S., China, and others compete for influence. However, Andrew Yeo demonstrates how Asia's complex array of bilateral and multilateral agreements may ultimately bring greater stability and order to a region fraught with underlying tensions.
Asia's Regional Architecture transcends traditional international relations models. It investigates change and continuity in Asia through the lens of historical institutionalism. Refuting claims regarding the demise of the liberal international order, Yeo reveals how overlapping institutions can promote regional governance and reduce uncertainty in a global context. In addition to considering established institutions such as the Association of Southeast Asian Nations and the Asia Pacific Economic Cooperation, he discusses newer regional arrangements including the East Asia Summit, Trans-Pacific Partnership, and the Belt and Road Initiative. This book has important implications for how policymakers think about institutional design and regionalism in Asia and beyond.
