Based on unprecedented access to the Ghanaian military barracks and inspired by the recent resurgence of coups in West Africa, Agyekum assesses why and how the Ghana Armed Forces were transformed from an organization that actively orchestrated coups into an institution that accepts the authority of the democratically elected civilian government. Focusing on the process of professionalization of the Ghanaian military, this ethnography based monograph examines both historical and contemporary themes, and assesses the shift in military personnel from ‘Buga Buga’ soldiers – uneducated, lower-class soldiers, human rights abusers – to a more ‘modern’ fighting force.
Описание: What is it like working as a barrister in the 21st century? The independent Bar has transformed in the last 30 years into a commercialised, enterprising profession. Based on interviews with and observation of barristers and chambers’ staff, this book identifies key changes that have taken place at the Bar and how these are reshaping and reformulating barristers’ professionalism and working culture. Readers are provided with the first empirical overview of the depth, scope and effects of a multi-faceted reform programme that has been imposed on the profession and explores how practitioners have responded. It analyses how this once unified profession has fragmented, as the lived experiences of barristers in different practice areas have diverged. Highly specialised sets of chambers now operate like businesses, whilst others, who are dependent on legal aid funding, struggle to survive. This book offers a unique examination of different sites of change: how the chambers model has evolved, how entrepreneurial barristers market themselves, how aspirant law students prepare to enter the profession and how regulatory and procedural reforms have imposed managerial constraints on practitioners. The conclusion considers what the far-reaching changes mean for the prospects of the Bar in England and Wales.

Описание: This book challenges the unacceptable gap between the positive rules of the international law governing armed hostilities and actual state practice. It discusses reducing the human suffering caused by this reality. The current law does not seem to be optimal in balancing the different interests of states' militaries and the humanitarian agenda. In response to this challenge, this book offers a new paradigm based on reality that may elevate the humanitarian threshold by replacing the currently problematic imperatives imposed upon militaries with professionally-based, therefore attainable, requirements. The aims of the suggested paradigm are to create an environment in which full abidance by the law becomes a realistic norm, thus facilitating a second, more important aim of reducing human suffering. Militaries function in a professional manner; they develop and respect their doctrine, operational principles, fighting techniques and values. Their performances are not random or incidental. The suggested paradigm calls for leveraging the constraining elements that are latent in military professionalism. Talking professional language and adopting the professional way of thinking that underlies militaries' conduct makes it possible to identify and focus upon the core interests of a military in any given lawful war - those that ought to be taken into consideration - alongside those that can be sacrificed for the sake of the humanitarian concerns, while still allowing the military mission to be achieved. Indeed, leveraging professional standards and norms would establish a reasonable modus vivendi for a military, while allowing substantial new space for the humanitarian mission of the law.
