Environmental harms exert a significant toll and pose substantial economic costs on societies around the world. Although such harms have been studied from both legal and social science perspectives, these disciplinary-specific approaches are not, on their own, fully able to address the complexity of these environmental challenges. Many legal approaches, for example, are limited by their inattention to the motivations behind environmental offences, whereas many social science approaches are hindered by an insufficient grounding in current legislative frameworks.
This edited collection constitutes a pioneering attempt to overcome these limitations by uniting legal and social science perspectives. Together, the book's contributors forge an innovative socio-legal approach to more effectively respond to, and to prevent, environmental harms around the world. Integrating theoretical and empirical work, the book presents carefully selected illustrations of how legal and social science scholarship can be brought together to improve policies. The various chapters examine how a socio-legal approach can ultimately lead to a more comprehensive understanding of environmental harms, as well as to innovative and effective responses to such environmental offences.
The trade aspects of risk and the risk aspects of trade deserve more systematic and genuine interdisciplinary attention if we are to really understand the global, international and supranational dimensions of risk regulation. This book brings together legal and social science research on risk regulation from across the world to explore risk regulation in a trade context. The interdisciplinary collaboration provided in this book is needed to address the trade versus risk balancing act both in empirical and theoretical terms.
Although it is obvious that legal, social, cultural and political matters interfere with risk regulation, analyses in which these interferences are adequately considered are lacking. In one way or another, all chapters in this book address the issue of scientific uncertainty, the governance arrangements around expertise or both. Issues such as transparency, trust, legitimacy and precaution also become particularly important given the political, multi-actor and multi-level governance characteristics of the balancing act between trade and risk regulation.
This book highlights and examines these concerns, going on to provide a critical assessment of the EU regulation of trade and risk both from external and internal perspectives. This book's exploration of the balancing act between trade and risk regulation will be increasingly important to students of law and social sciences as they move to a shared, interdisciplinary understanding.

In Unearthing Conflict Fabiana Li analyzes the aggressive expansion and modernization of mining in Peru since the 1990s to tease out the dynamics of mining-based protests. Issues of water scarcity and pollution, the loss of farmland, and the degradation of sacred land are especially contentious. She traces the emergence of the conflicts by discussing the smelter-town of La Oroya—where people have lived with toxic emissions for almost a century—before focusing her analysis on the relatively new Yanacocha gold mega-mine. Debates about what kinds of knowledge count as legitimate, Li argues, lie at the core of activist and corporate mining campaigns. Li pushes against the concept of "equivalence"—or methods with which to quantify and compare things such as pollution—to explain how opposing groups interpret environmental regulations, assess a project’s potential impacts, and negotiate monetary compensation for damages. This politics of equivalence is central to these mining controversies, and Li uncovers the mechanisms through which competing parties create knowledge, assign value, arrive at contrasting definitions of pollution, and construct the Peruvian mountains as spaces under constant negotiation.
