Описание: This volume examines the implementation of the Return Directive from the perspective of judicial dialogue. While the role of judges has been widely addressed in European asylum law and EU law more generally, their role in EU return policy has hitherto remained under explored. This volume addresses the interaction and dialogue between domestic judiciaries and European courts in the implementation of European return policy. The book brings together leading authors from various backgrounds, including legal scholars, judges and practitioners. This allows the collection to offer theoretical and practical perspectives on important questions regarding the regulation of irregular migration in Europe, such as: what constitutes inadequate implementation of the Directive and under which conditions can judicial dialogue solve it? How can judges ensure that the right balance is struck between effective return procedures and fundamental rights? Why do we see different patterns of judicial dialogue in the Member States when it comes to particular questions of return policy, for example regarding the use of detention? These questions are more timely than ever given the shifting public discourse on immigration and the growing political backlash against immigration courts. This book will be essential reading for all scholars and practitioners in the fields of immigration law and policy, EU law and public law.

Описание: Two centuries before the daring exploits of Navy SEALs and Marine Raiders captured the public imagination, the U.S. Navy and Marine Corps were already engaged in similarly perilous missions: raiding pirate camps, attacking enemy ships in the dark of night, and striking enemy facilities and resources on shore. Even John Paul Jones, father of the American navy, saw such irregular operations as critical to naval warfare. With Jones's own experience as a starting point, Benjamin Armstrong sets out to take irregular naval warfare out of the shadow of the blue-water battles that dominate naval history. This book, the first historical study of its kind, makes a compelling case for raiding and irregular naval warfare as key elements in the story of American sea power. Beginning with the Continental Navy, Small Boats and Daring Men traces maritime missions through the wars of the early republic, from the coast of modern-day Libya to the rivers and inlets of the Chesapeake Bay. At the same time, Armstrong examines the era's conflicts with nonstate enemies and threats to American peacetime interests along Pacific and Caribbean shores. Armstrong brings a uniquely informed perspective to his subject; and his work - with reference to original naval operational reports, sailors' memoirs and diaries, and officers' correspondence - is at once an exciting narrative of danger and combat at sea and a thoroughgoing analysis of how these events fit into concepts of American sea power. Offering a critical new look at the naval history of the Early American era, this book also raises fundamental questions for naval strategy in the twenty-first century.

Описание:

Katharine Cleland's Irregular Unions provides the first sustained literary history of clandestine marriage in early modern England and reveals its controversial nature in the wake of the Elizabethan Religious Settlement, which standardized the marriage ritual for the first time. Cleland examines many examples of clandestine marriage across genres. Discussing such classic works as The Faerie Queene, Othello, and The Merchant of Venice, she argues that early modern authors used clandestine marriage to explore the intersection between the self and the marriage ritual in post-Reformation England.

The ways in which authors grappled with the political and social complexities of clandestine marriage, Cleland finds, suggest that these narratives were far more than interesting plot devices or scandalous stories ripped from the headlines. Instead, after the Reformation, fictions of clandestine marriage allowed early modern authors to explore topics of identity formation in new and different ways.

Описание:

Warlords are individuals who control small territories within weak states, using a combination of force and patronage. In this book, Kimberly Marten shows why and how warlords undermine state sovereignty. Unlike the feudal lords of a previous era, warlords today are not state-builders. Instead they collude with cost-conscious, corrupt, or frightened state officials to flout and undermine state capacity. They thrive on illegality, relying on private militias for support, and often provoke violent resentment from those who are cut out of their networks. Some act as middlemen for competing states, helping to hollow out their own states from within. Countries ranging from the United States to Russia have repeatedly chosen to ally with warlords, but Marten argues that to do so is a dangerous proposition.

Drawing on interviews, documents, local press reports, and in-depth historical analysis, Marten examines warlordism in the Pakistani tribal areas during the twentieth century, in post-Soviet Georgia and the Russian republic of Chechnya, and among Sunni militias in the U.S.-supported Anbar Awakening and Sons of Iraq programs. In each case state leaders (some domestic and others foreign) created, tolerated, actively supported, undermined, or overthrew warlords and their militias. Marten draws lessons from these experiences to generate new arguments about the relationship between states, sovereignty, "local power brokers," and stability and security in the modern world.
