The rapid development of China’s economy has resulted in various kinds of conflict of interest (COI). This study focuses on how COI is resolved in Chinese civil court hearings via discourse information processing. Based on Discourse Information Theory, and the notions of Context Model Schema and Discourse Space, an analytical framework is constructed for the description, analysis and interpretation of the language used in Chinese court hearings.
Data analysis has revealed the following major findings: a) litigants in Chinese civil court hearings mainly resort to three information categories when making interest appeals: subjective, objective and explanatory information; b) the process of interest negotiation in court hearings is greatly influenced by such sociological, psychological and discursive factors as identities, intentions, information sharing status, discourse expectations, etc.; and c) different discourse management strategies are adopted to promote conciliation between litigants, among which information management, cognitive management and linguistic management are the most frequently used.
Political Discourse Analysis addresses the challenges facing political actors at all levels of society and across a range of regimes. It shows how discursive legitimisation strategies can vary on a continuum ranging from the stabilising effects of institutional discourse and the management of destabilising factors inherent in new types of media to the destabilising potential of rhetorical devices and deliberate de-legitimisation strategies used to attack opponents.
The diverse approaches show how political actors strive to maintain control in the context of democratic deficit and crisis in developed societies while addressing growing global threats to stability in all regimes. While many actors seek legitimisation through the institutional structure, media or rhetoric, others may seek to weaken any opposition to them through de-legitimisation. In this collection Butler provides the reader with replicable methods that can be adapted to political contexts.
The contributions collected in this book deal with the representation of conflict in the periodical press, which has often been an arena of adversarial stances, staged and enacted either within the same publication or enlarged to involve various newspapers and magazines in a series of provocations and replies. Underlying all the contributions is the awareness that the periodical press provides an ideal terrain for research on the discursive representation of conflict, having the prerogative to combine insight with a constant updating of the debate. The issue is approached in an interdisciplinary perspective, bringing linguistics and discourse analysis with Periodical Studies, hence highlighting the connection between language and ideology. The focus on lexical choices and rhetorical devices used to tackle current controversial issues such as Brexit, immigration, violence in sports, policies regarding health and food, women’s role and legal matters ultimately transcends national boundaries to become more widely representative of today’s discourses of conflict.
