Описание:

In recent years serious concerns emerged over the state of European democracy. Many democracy indices are reporting a year-on-year drift towards less liberal politics in the countries of the European Union. Polls regularly suggest that the voters are coming to question democratic norms more seriously than for many decades.

Here, Richard Youngs assesses these risks as many analysts, journalists and politicians stressed the danger of Europe descending into an era of conflict, driven by xenophobic nationalism and nativist authoritarians slowly dismantling liberal democratic rights. In 2020, the Covid-19 pandemic has intensified these fears. There is another side of the democratic equation, however. Youngs argues that governments, EU institutions, political parties, citizens and civil society organisations have gradually begun to push back in defence of democracy. With each chapter, Youngs shows how many governmental, political and social actors have developed responses to Europe's democratic malaise at multiple levels. Europe's democracy problems have been grave and far-reaching. Yet, a spirit of democratic resistance has slowly taken shape.

This book argues that the pro-democratic fightback may be belated, but it is real and has assumed significant traction with various types of democratic reform underway, including citizen initiatives, political-party changes, digital activism and EU-level responses.

Описание: Changing Legal and Civic Culture in an Illiberal Democracy is a unique empirical study on recent developments in legal and civic consciousness in Hungary. Drawing its methodology from social psychology, this book illuminates a shift in legal consciousness during the time in which Orb?n’s government has cemented Hungary’s reputation as an illiberal democracy. The book foregrounds the voices of the Hungarian population in how they view the shift towards increasingly right-wing politics and an erosion of the rule of law. It opens with an extensive theoretical introduction of the historical development and psychological dimensions of legal consciousness in Hungary and relates the Hungarian research to international developments. It then presents its empirical results and offers a jargon-free account of ordinary people’s changing perceptions of their relationship to Hungary’s civic and legal cultures, before finally examining the correlations between surveys. Methodologically, the book establishes that theories of legal consciousness and social change are bolstered by empirical data.Offering a new way of approaching shifts in legal consciousness and the rule of law in Balkan and Eastern European countries, this text will be of great interest to researchers and students of social psychology, law, international relations and Central European studies.

Описание:

Several years after the first Greek bailout, the integration project of the European Union faces an interlocking set of political, economic, legal and social challenges that go to the very core of its existence. Austerity is the order of the day, and citizens in both debtor and creditor states increasingly turn to the political movements of the far left and right, anti-politics and street protests to vent their frustration.

This book demonstrates the limits of constitutionalism in the EU. It explores the 'twin crises' - the failure of the Constitutional Treaty in 2005 and the more recent Eurozone crisis - to illuminate both the possibilities and pitfalls of the integration project. It argues that European integration overburdened law in an attempt to overcome deep-seated political deficiencies. It further contends that the EU shifted from an unsuccessful attempt at democratisation via politicisation (the Constitutional Treaty), to an unintended politicisation without democratisation (the Eurozone crisis) only a few years later. The book makes the case that this course is unsustainable and threatens the goal of European unity.

This text will be of key interest to students and scholars in the fields of EU studies, EU law, democracy studies, constitutional studies and international relations.
