They made claims to territory using legal arguments drawn from their own understanding of a law that applies between peoples - a kind of law of nations, comparable to that being developed by Europeans. The contributors to this volume argue that in the face of indigenous legal arguments, European justifications of colonization should be understood not as an original and originating legal discourse but, at least in part, as a form of counter-claim. Native Claims: Indigenous Law against Empire, 1500-1920 brings together the work of eminent social and legal historians, literary scholars, and philosophers, including Rolena Adorno, Lauren Benton, Duncan Ivison, and Kristin Mann. Their combined expertise makes this volume uniquely expansive in its coverage of a crucial issue in global and colonial history. The various essays treat sixteenth- and seventeenth-century Latin America, seventeenth- and eighteenth-century North America (including the British colonies and French Canada), and nineteenth-century Australasia and Africa. The result was the creation of a system of property in Maine that defied English law, and preserved Native power and territory. Eventually, ordinary colonists, dissident speculators, and grasping officials succeeded in undermining and finally destroying this arrangement, a process that took place in councils and courtrooms, in taverns and treaties, and on battlefields. Properties of Empire challenges assumptions about the relationship between Indigenous and imperial property creation in early America, as well as the fixed nature of Indian "sales" of land, revealing the existence of a prolonged struggle to re-interpret seventeenth-century land transactions and treaties well into the eighteenth century. The ongoing struggle to construct a commonly agreed-upon culture of landownership shaped diplomacy, imperial administration, and matters of colonial law in powerful ways, and its legacy remains with us today.

Описание: On October 3, 1873, the U.S. Army hanged four Modoc headmen at Oregon's Fort Klamath. The condemned had supposedly murdered the only U.S. Army general to die during the Indian wars of the nineteenth century. Their much-anticipated execution marked the end of the Modoc War of 1872–73. But as Boyd Cothran demonstrates, the conflict's close marked the beginning of a new struggle over the memory of the war. Examining representations of the Modoc War in the context of rapidly expanding cultural and commercial marketplaces, Cothran shows how settlers created and sold narratives of the conflict that blamed the Modocs. These stories portrayed Indigenous people as the instigators of violence and white Americans as innocent victims.
Cothran examines the production and circulation of these narratives, from sensationalized published histories and staged lectures featuring Modoc survivors of the war to commemorations and promotional efforts to sell newly opened Indian lands to settlers. As Cothran argues, these narratives of American innocence justified not only violence against Indians in the settlement of the West but also the broader process of U.S. territorial and imperial expansion.

World-Making Stories is a collection of Maidu creation stories that will help readers appreciate California's rich cultural tapestry. At the beginning of the twentieth century, renowned storyteller Hanc'ibyjim (Tom Young) performed Maidu and Atsugewi stories for anthropologist Ronald B. Dixon, who published these stories in 1912. The resulting Maidu Texts presented the stories in numbered block texts that, while serving as a source of linguistic decoding, also reflect the state of anthropological linguistics of the era by not conveying a sense of rhetorical or poetic composition. Sixty years later, noted linguist William Shipley engaged the texts as oral literature and composed a free verse literary translation, which he paired with the artwork of Daniel Stolpe and published in a limited-edition four-volume set that circulated primarily to libraries and private collectors.
Here M. Eleanor Nevins and the Weje-ebis (Keep Speaking) Jamani Maidu Language Revitalization Project team illuminate these important tales in a new way by restoring Maidu elements omitted by William Shipley and by bending the translation to more closely correspond in poetic form to the Maidu original. The beautifully told stories by Hanc'ibyjim are accompanied by Stolpe's intricate illustrations and by personal and pedagogical essays from scholars and Maidu leaders working to revitalize the language. The resulting World-Making Stories is a necessity for language revitalization programs and an excellent model of indigenous community-university collaboration.

How do we live in and with empire? The contributors to Ethnographies of U.S. Empire pursue this question by examining empire as an unequally shared present.
