Описание: This book advances an approach that combines the individual and the structural, systemic dimensions of data protection. It considers the right to data protection under the EU Charter and its relationship to the secondary legislation. Furthermore, the case law of the Court of Justice of the EU as well as current academic conceptualizations are analysed. The author finds that current approaches invariably link data protection to privacy and often fail to address the structural implications of data processing. He therefore suggests a dualistic approach to data protection: in its individual dimension, data protection aims to protect natural persons and their rights, while the structural dimension protects the democratic society as a whole from the adverse effects of data processing. Using this approach, the full potential of an independent right to data protection can be realized. Researchers, practitioners and students will find this a valuable resource on the rationales, scope and application of data protection. Felix Bieker is Legal Researcher at the Office of the Data Protection Commissioner of Schleswig-Holstein (Unabh?ngiges Landeszentrum f?r Datenschutz) in Kiel, Germany.
Imagining the International interrogates mainstream understandings of international crime and international justice to tease out their ethical limits and possibilities.
International crime and justice are powerful ideas, associated with a vivid imagery of heinous atrocities, injured humanity, and an international community seized by the need to act. Through an analysis of archival and contemporary data, Imagining the International provides a sustained picture of how ideas about international crime and justice are given content and the global interrelations they enable and foreclose. Nesam McMillan argues that dominant approaches to conceptualizing distinctly international crime and international justice are problematic because they disconnect these phenomena from the everyday, fostering distance between those who have experienced international crime and those who have not. McMillan draws on interdisciplinary work spanning law, criminology, humanitarianism, socio-legal studies, cultural studies, and human geography to show how understandings of international crime and justice hierarchize, spectacularize, and appropriate the suffering of others and promote an ideal of justice fundamentally disconnected from life as it is lived. McMillan critiques the mode of global interconnection they offer, one which bears resemblance to past colonial global approaches and which seeks to foster community through the image of crime and the practice of punitive justice. This book powerfully underscores the importance of the ideas of international crime and justice and their significant limits, cautioning against their continued valorization.
Описание: This book critically examines transitional justice in Mexico. Whilst transitional justice should contribute to the advancement of liberal democracy and, consequently, generate the following benefits: truth, justice, political reconciliation, peace, this book argues that Mexico is a case of transitional injustice.

Описание: On January 10, 1966, Klansmen murdered civil rights leader Vernon Dahmer in Forrest County, Mississippi. Despite the FBI’s growing conflict against the Klan, recent civil rights legislation, and progressive court rulings, the Imperial Wizard promised his men: “no jury in Mississippi would convict a white man for killing a nigger.” Yet this murder inspired change. Since the onset of the civil rights movement, local authorities had mitigated federal intervention by using subtle but insidious methods to suppress activism in public arenas. They perpetuated a myth of Forrest County as a bastion of moderation in a state notorious for extremism. To sustain that fiction, officials emphasized that Dahmer’s killers hailed from neighboring Jones County and pursued convictions vigorously. Although the Dahmer case became a watershed in the long struggle for racial justice, it also obscured Forrest County’s brutal racial history.Patricia Michelle Boyett debunks the myth of moderation by exploring the mob lynchings, police brutality, malicious prosecutions, and Klan terrorism that linked Forrest and Jones Counties since their founding. She traces how racial atrocities during World War II and the Cold War inspired local blacks to transform their counties into revolutionary battlefields of the movement. Their electrifying campaigns captured global attention, forced federal intervention, produced landmark trials, and chartered a significant post–civil rights crusade. By examining the interactions of black and white locals, state and federal actors, and visiting activists from settlement to contemporary times, Boyett presents a comprehensive portrait of one of the South’s most tortured and transformative landscapes.
