Serving Refugee Children shows the struggles and traumatic experiences that unaccompanied and undocumented children undergo they seek safety in the United States and instead find imprisonment, separation from their families, and immigration enforcement raids. Current legislation and bureaucracy limit publication of first-person narratives from unaccompanied and undocumented children, but service providers and grassroots activists authoring the pieces in this collection bear witness to the children’s brave human spirits in their search for safety in the United States. Through the power of storytelling, Serving Refugee Children exposes the many hardships unaccompanied and undocumented children endure, including current detention center conditions. No child should have to live the persecution suffered by children featured in these stories, nor should they have to embark upon perilous journeys across Latin America or be subjected to the difficult immigration court process unaided. Researchers and readers who believe that the emotional bonding of storytelling can humanize discussions and lead to immigration policies that foster a culture of engagement and interconnectedness will be interested in this volume.

Описание: This book provides a thorough legal analysis of the United States Migrant Interdiction Program, examining the United States' compliance with its obligations under municipal and international law as it interdicts individuals at sea, conducts status determinations, and returns those interdicted to their home countries. This book also examines the rights of the small number of refugees and individuals at risk of torture detained in Guantanamo Bay, Cuba, awaiting resettlement in third countries. Policy-makers, students and scholars will benefit from this book's clarification of the legal obligations of nations engaged in extraterritorial status determination and detention, as well as its blueprint for compliance with international human rights and refugee law. As the first book of its kind devoted to the United States' interdiction program, this work represents an important contribution to scholarship in refugee law and policy, US constitutional law, international maritime law, and international human rights law.

Описание: The early 1980s marked a critical turning point for the rise of modern mass incarceration in the United States. The Mariel Cuban migration of 1980, alongside increasing arrivals of Haitian and Central American asylum-seekers, galvanized new modes of covert warfare in the Reagan administration's globalized War on Drugs. Using newly available government documents, Shull demonstrates how migrant detention operates as a form of counterinsurgency at the intersections of U.S. war-making and domestic carceral trends. As the Reagan administration developed retaliatory enforcement measures to target a racialized specter of mass migration, it laid the foundations of new forms of carceral and imperial expansion.

Reagan's war on immigrants also sowed seeds of mass resistance. Drawing on critical refugee studies, community archives, protest artifacts, and oral histories, Detention Empire also shows how migrants resisted state repression at every turn. People in detention and allies on the outside—including legal advocates, Jesse Jackson's Rainbow Coalition, and the Central American peace and Sanctuary movements—organized hunger strikes, caravans, and prison uprisings to counter the silencing effects of incarceration and speak truth to U.S. empire. As the United States remains committed to shoring up its borders in an era of unprecedented migration and climate crisis, reckoning with these histories take on new urgency.

Описание:

More than a quarter of a million LGBTQ-identified migrants in the United States lack documentation and constantly risk detention and deportation. LGBTQ migrants around the world endure similarly precarious situations. Eithne Luibhéid's and Karma R. Chávez’s edited collection provides a first-of-its-kind look at LGBTQ migrants and communities. The academics, activists, and artists in the volume center illegalization, detention, and deportation in national and transnational contexts, and examine how migrants and allies negotiate, resist, refuse, and critique these processes. The works contribute to the fields of gender and sexuality studies, critical race and ethnic studies, borders and migration studies, and decolonial studies.

Bridging voices and works from inside and outside of the academy, and international in scope, Queer and Trans Migrations illuminates new perspectives in the field of queer and trans migration studies.

Описание:

International migration has been described as one of the defining issues of the twenty-first century. While a lot is known about the complex nature of migratory flows, surprisingly little attention has been given to one of the most prominent responses by governments to human mobility: the practice of immigration detention.

Intimate Economies of Immigration Detention provides a timely intervention, offering much needed scrutiny of the ideologies, policies and practices that enable the troubling, unparalleled and seemingly unbridled growth of immigration detention around the world. An international collection of scholars provide crucial new insights into immigration detention recounting at close range how detention's effects ricochet from personal and everyday experiences to broader political-economic, social and cultural spheres. Contributors draw on original research in the US, Australia, Europe, and beyond to scrutinise the increasingly tangled relations associated with detention operation and migration management. With new theoretical and empirical perspectives on detention, the chapters collectively present a toolbox for better understanding the forces behind and broader implications of the seemingly uncontested rise of immigration detention.

This book is of great interest to those who study political economy, economic geography and immigration policy, as well as policy makers interested in immigration.

Описание:

This book examines the extraordinary nature of the power of preventive detention, which permits executive dispensation of the personal liberty of an individual on the mere apprehension that, if free and unfettered, he may commit acts prejudicial to national security or public order. In light of the extraordinary scope of this power, it, therefore, contends that the scope of the power should be confined to genuine emergencies threatening the life of the nation.

Against the above background, this book sheds light on the fact that Article 149 of the Federal Constitution of Malaysia empowers the Parliament to enact preventive detention laws authorizing the executive branch of government to preventively detain individuals without the precondition of an emergency. Furthermore, the Constitution does not stipulate adequate safeguards for mitigating the harshness of preventive detention laws.

This book makes it manifestly evident that the weaknesses of the constitutional provisions concerning preventive detention have enabled succeeding generations of executives in Malaysia to not only enact a series of preventive detention statues for arrogating to themselves wide powers concerning preventive detention but also to rely on them for arbitrarily detaining their political adversaries.

Consequently, on the basis of this analysis, this book puts forward concrete recommendations for insertion in the Constitution detailed norms providing for legal limits on the wide power of the executive concerning preventive detention. The insertion of such norms would ensure the maintenance of a delicate balance between protecting national interests and, simultaneously, observing respect for an individual's right to protection from arbitrary deprivation of liberty. This book is useful for academics and students of comparative constitutional law, human rights and Asian law. The extensive law reform analysis undertaken in this book also greatly benefits the policy makers in Malaysia and the policy makers of constitutional polities facing similar problems with the issue of circumscribing the scope of the powers concerning preventive detention.

Описание: The Immigration and Nationality Act (INA) authorizes and in some cases requires the Department of Homeland Security (DHS) to detain non-U.S. nationals (aliens) arrested for immigration violations that render them removable from the United States. An alien may be subject to detention pending an administrative determination as to whether the alien should be removed, and, if subject to a final order of removal, pending efforts to secure the aliens removal from the United States. The immigration detention scheme is multifaceted, with different rules that turn on several factors, such as whether the alien is seeking admission into the United States or has been lawfully admitted into the country; whether the alien has engaged in certain proscribed conduct; and whether the alien has been issued a final order of removal. In many instances DHS maintains discretion to release an alien from custody. But in some instances, such as when an alien has committed specified crimes, the governing statutes have been understood to allow release from detention only in limited circumstances. This book focuses on current topics concerning immigration detention and enforcement.
