Описание:

In 1971, authorities in West Pakistan, now Pakistan, perpetrated mass atrocities in East Pakistan, now Bangladesh. The West and the Birth of Bangladesh explores responses in Washington, Ottawa, and London during the crucial first months of the crisis, investigating the debates and policies pursued. The United States favoured appeasement of Islamabad. Canada was unwilling to hazard bilateral ties with Pakistan. The UK showed greater willingness to coerce Islamabad into ending its oppression. This insightful book reveals how, even as human rights movements began to emerge in the West, government actors there remained too preoccupied with national interests to take firm action during the crisis.

Описание:

Massacres and mass killings have always marked if not shaped the history of the world and as such are subjects of increasing interest among historians. The premise underlying this collection is that massacres were an integral, if not accepted part (until quite recently) of warfare, and that they were often fundamental to the colonizing process in the early modern and modern worlds. Making a deliberate distinction between ‘massacre’ and ‘genocide’, the editors call for an entirely separate and new subject under the rubric of ‘Massacre Studies’, dealing with mass killings that are not genocidal in intent. This volume offers a reflection on the nature of mass killings and extreme violence across regions and across centuries, and brings together a wide range of approaches and case studies.

Описание:

The mass graves from our long human history of genocide, massacres, and violent conflict form an underground map of atrocity that stretches across the planet's surface. In the past few decades, due to rapidly developing technologies and a powerful global human rights movement, the scientific study of those graves has become a standard facet of post-conflict international assistance. Digging for the Disappeared provides readers with a window into this growing but little-understood form of human rights work, including the dangers and sometimes unexpected complications that arise as evidence is gathered and the dead are named.

Adam Rosenblatt examines the ethical, political, and historical foundations of the rapidly growing field of forensic investigation, from the graves of the "disappeared" in Latin America to genocides in Rwanda and the former Yugoslavia to post–Saddam Hussein Iraq. In the process, he illustrates how forensic teams strive to balance the needs of war crimes tribunals, transitional governments, and the families of the missing in post-conflict nations. Digging for the Disappeared draws on interviews with key players in the field to present a new way to analyze and value the work forensic experts do at mass graves, shifting the discussion from an exclusive focus on the rights of the living to a rigorous analysis of the care of the dead. Rosenblatt tackles these heady, hard topics in order to extend human rights scholarship into the realm of the dead and the limited but powerful forms of repair available for victims of atrocity.

Описание:

The problem of preventing mass human-rights violations and atrocity crimes is one of the key issues in international relations. The book presents the capacity of the international community in the field. The available instruments of early warning, preventive diplomacy as well as legal, economic, and military measures of prevention are included. Cases of Chechnya, Rwanda, C?te d'Ivoire and Libya allowed the analysis of international engagement in typical situations involving mass human-rights violations and atrocity crimes related to self-determination, ethnic tensions, power struggles and attempts to overthrow a dictatorship. They show that although the international community has significantly increased its capacity to prevent, it has not created a coherent system of prevention.

Описание: This book brings a new focus to the ongoing debate on holding perpetrators of massive humanitarian and human rights violations accountable in countries in transition. It provides a clear-cut and comprehensive legal analysis of the content and nature of a state's obligations to investigate and prosecute as enshrined in the most important humanitarian and human rights treaties; it disentangles the common fallacy that these procedural obligations are naturally rooted and clearly spelled out in the general human rights treaties; and it explains the flaws in an absolutist interpretation. This analysis serves to understand whether such procedural obligations, if narrowly construed, act as impediments to countries emerging from periods of conflict or systematic repression in the face of contingent circumstances and the formidable dilemmas raised by a univocal understanding of justice as retribution.Exploring the latest instances of interpretation and application via an analysis of state practice, the jurisprudence of treaty bodies, international courts and tribunals, soft law instruments, and doctrinal contributions, the book also addresses the complex issue of amnesty, and other transitional justice mechanisms designed to restore peace and facilitate transition traditionally included in national reconciliation programs, and criticizes the contention that amnesty is always prohibited by international law. It also considers these problems from the viewpoint of the International Criminal Court, focusing on the cases of Uganda and Colombia after the 2016 peace agreement.Lastly, the volume offers a detailed analysis of techniques that may neutralize relevant obligations under international law, such as denunciation, derogation, limitation, and the public international law defenses of force majeure and necessity. Drawing attention to the importance of a multidisciplinary and practical approach to these unsettling questions, and endorsing a pluralistic notion of accountability, the book will appeal to legal scholars and transitional justice experts as well as practitioners, human rights advocates, and government officials.Dr Jacopo Roberti di Sarsina is an International Law Expert at the Alma Mater Studiorum - University of Bologna School of Law, and a dual-qualified lawyer (Italy and New York). He completed a PhD in public international law, label Doctor Europaeus, at the School of International Studies, University of Trento, holds an LLM from NYU School of Law, and read law at the University of Bologna.

Is such law, therefore, constitutionally unable to make any sense of the most catastrophic conflagrations of our time? Drawing on the experience of several prosecutions, this book, trenchantly diagnoses the law`s limits.
