Описание: South Asia has had a tumultuous and varied experience with constitutional democracy that predates the recent rise in populism (and its study) in established democracies. And yet, this region has remained largely ignored by constitutional studies and democracy scholars. This book addresses this gap and presents a contribution to the South Asia-centric literature on the topic of the stability and resilience of constitutional democracies. Chapters deal not only with relatively well known South Asian countries such as India, Bangladesh, Pakistan, and Sri Lanka, but also with countries often ignored by scholars, such as Bhutan, Nepal, Maldives, and Afghanistan. The contributions consider the design and functioning of an array of institutions and actors, including political parties, legislatures, the political executive, the bureaucracy, courts, fourth branch / guarantor institutions (such as electoral commissions), the people, and the military to examine their roles in strengthening or undermining constitutional democracy across South Asia. Each chapter offers a contextual and jurisdictionally-tethered account of the causes behind the erosion of constitutional democracy, and some examine the resilience of constitutional institutions against democratic erosion.
Описание: This report reviews the impact of trade facilitation initiatives in Asia and the Pacific since the coronavirus disease (COVID-19) pandemic began and discusses how to increase supply chain resilience.
Supply chain disruptions caused by the pandemic have underscored the need for digital and paperless trade procedures. A special chapter examines the pandemic's impact on the supply chains of critical goods such as vaccines, personal protective equipment, and food, and provides policy suggestions for enhancing supply chain resilience and trade facilitation. This is the third biennial progress report on trade facilitation implementation in Asia and the Pacific jointly prepared by the Asian Development Bank and the United Nations Economic and Social Commission for Asia and the Pacific.
Описание: This open access book explains why a democratic reckoning will start when European societies win the fight against COVID-19.
Have democracies successfully mastered the challenges of the pandemic? How has the coronavirus impacted democratic principles, processes and values? At the heels of the worst public health crisis in living memory, this book shines an unforgiving light on the side-lining of parliaments, the ruling by governmental decrees and the disenfranchisement of the people in the name of fighting COVID-19.
Pandemocracy in Europe situates the dramatic impact of COVID-19, and the fight against the virus, on Europe's democracies. Throughout its 17 contributions the book sets the theoretical stage and answers the democratic questions engaged by health emergencies. Seven national case studies - UK, Germany, Italy, Sweden, Hungary, Switzerland, and France - show, each time with a pronounced focus on a particular element of democracy, how different states reacted to the pandemic. The book also shifts the analytical gaze beyond the nation state towards international settings, looking at the effects on the European Union and considering the impact on populist movements.
Bridging disciplines and uniting a stellar cast of scholars on democracy, rule of law and constitutionalism, the book provides contours and nuances to a year of debates in political science, international relations and law on the impact of the virus on democracies.
In times of uncertainty, Pandemocracy in Europe provides analysis and answers to the democratic challenges of the coronavirus.

Описание: Constitutional and Administrative Law is a clear and concise text which allows students to easily get to the heart of the subject.
This book compares the evolution of the legal systems of Central Asia, Europe, and East Asia, under the impact of economic factors, both structural and crisis-inspired. The COVID-19, one of the severest challenges faced by humanity, alters the social order and the way people think.
Already, changes impact the socio-economic and political-legal spheres. Geopolitical and geoeconomic shifts affect the place of states and regions in the world order. The UK’s withdrawal from the EU, superimposed onto the pandemic, inflicted not only political and socio-economic losses but reputational losses as well. It signaled the limits of regional integration if the world’s most successful economic grouping needed to revise its own development.
This book analyses three salient international political/legal problems for states and regions of Eurasia: trade and financial issues, regional and interregional issues, industrial and socioeconomic issues. It also looks at the US trade policy towards Eurasia and China, the US military presence in South Korea, the EU experience for the EAEU, as well as WTO issues, etc. It follows Le r?gionalisme et ses limites (2016), Mutations de soci?t? et r?ponses du droit (2017), On the European and Asian origins of legal and political systems (2018) and The Challenge of change in the legal and political systems of Eurasia and the New Silk Road (2020).

Описание: Constitutional law has helped make Americans unhealthy. Drawing from law, history, political theory, and public health research, Constitutional Contagion explores the history of public health laws, the nature of liberty and individual rights, and the forces that make a nation more or less vulnerable to contagion. In this groundbreaking work, Wendy Parmet documents how the Supreme Court departed from past practice to stymie efforts to mitigate the COVID-19 pandemic and demonstrates how pre-pandemic court decisions helped to shatter social contracts, weaken democracy, and perpetuate the inequities that made the United States especially vulnerable when COVID-19 struck. Looking at judicial decisions from an earlier era, Parmet argues that the Constitution does not compel the stark individualism and disregard of public health that is evident in contemporary constitutional law decisions. Parmet shows us why, if we are to be a healthy nation, constitutional law must change.
