Описание: This book looks at responsible government under the Australian Constitution. It undertakes a detailed examination of the history leading to the incorporation of responsible government into the Constitution, examining the political history and constitutional ideas which informed the framers’ views. It draws on this history to develop a theory of responsible government and explore its implications for the interpretation of the Constitution and the structure of modern government in Australia. The book fills a major gap in our knowledge of the intellectual background of the Australian Constitution by explaining the constitutional ideas that have shaped the text and structure of the Australian Constitution. It contributes to worldwide debates about constitutional interpretation by showing how rigorous use of history can lead to novel interpretations of constitutions without being tied to the dead hands of the founders.

Описание:

"An indispensable and provocative guide through the thicket of today's most challenging constitutional controversies by some of the most eminent judges of their time. It offers an invaluable peek behind the curtain of judicial decision making."

—David Cole, Professor of Law, Georgetown University

The Embattled
Constitution presents the
fourth collection of the James Madison lectures delivered at the NYU School of
Law, offering thoughtful examinations of an array of topics on civil liberties
by a distinguished group of federal judges, including Justice Stephen Breyer of
the U.S. Supreme Court. The result is a fascinating look into the minds of the
judges who interpret, apply, and give meaning to our “embattled Constitution.”

In these insightful
and incisive essays, the authors bring to bear decades of experience to explore
wide-ranging issues. Are today’s public schools racially segregated? To what
extent can the federal courts apply the Bill of Rights without legislative
guidance? And what are the criteria for the highest standards of judging and constitutional
interpretation? The authors also discuss how and why the Constitution came to
be embattled, shining a spotlight on the current polarization in both the
Supreme Court and the American body politic and offering careful and informed
analysis of how to bridge these divides.

Contributors include
Marsha S. Berzon, Michael Boudin, Stephen Breyer, Guido Calabresi, Robert H.
Henry, Robert Katzmann, Pierre N. Leval, M. Blane Michael, Davis S. Tatel, J.
Harvie Wilkinson, III, and Diane P. Wood.

Описание: A stirring collection of public talks and essays by an activist and former judge offers an intimate insider's view of South Africa's Constitution. This stirring collection of essays and talks by activist and former judge Albie Sachs is the culmination of more than 25 years of thought about constitution-making and non-racialism. Following the Constitutional Court's landmark Nkandla ruling in March 2016, it serves as a powerful reminder of the tenets of the Constitution, the rule of law and the continuous struggle to uphold democratic rights and freedoms. We, the People offers an intimate insider's view of South Africa's Constitution by a writer who has been deeply entrenched in its historical journey from the depths of apartheid right up to the politically contested present. As a second-year law student at the University of Cape Town, Sachs took part in the Defiance Campaign and went on to attend the Congress of the People in Kliptown, where the Freedom Charter was adopted in 1955. Three decades later, shortly after the bomb attack in Maputo that cost him his arm and the sight in one eye, he was called on by the Constitutional Committee of the African National Congress to co-draft (with Kader Asmal) the first outline of a Bill of Rights for a new democratic South Africa. In 1994, he was appointed by Nelson Mandela to the Constitutional Court, where he served as a judge until 2009. We, the People contains some of Sachs' most memorable public talks and writings, in which he takes us back to the broad-based popular foundations of the Constitution in the Freedom Charter. He picks up on Oliver Tambo's original vision of a non-racial future for South Africa, rather than one based on institutionalised power-sharing between the races. He explores the tension between perfectability and corruptibility, hope and mistrust, which lies at the centre of all constitutions. Sachs discusses the enforcement of social and economic rights, and contemplates the building of the Constitutional Court in the heart of the Old Fort Prison as a mechanism for reconciling the past and the future. Subjective experience and objective analysis interact powerfully in a personalised narrative that reasserts the value of constitutionality not just for South Africans, but for people striving to advance human dignity, equality and freedom across the world today.

The contributions in this book range from case studies to comparative analyses and theoretical arguments.

Описание: This book speaks to debates on law, constitutionalism, and the contested terrain of political identity in modern India. Set against the overwhelmingly liberal design of the Indian Constitution, the book demonstrates a tendency in the Constitution and its practice to identify the Indian people in parochial and communal terms. This tendency is identified as India's Communal Constitution and its imprint on contemporary constitutional practice is illustrated by drawing on the constitutional practice as it addresses religious freedom, personal law, minority rights and the identification of caste groups. Thus, casting the Constitution and its practice as a field of contest, the aspiration to define the Indian people as a community of individual citizens is brought face to face with its antagonists. The most significant of these antagonists is the tendency to cast the Indian people as a collection of communities which this book examines and details as India's Communal Constitution.

Описание: Based on over 150 interviews with UK judges, politicians and officials, this is the first authoritative account of relations between the judiciary and government since the Constitutional Reform Act 2005. The authors argue that judicial independence is in fact a product of politics rather than insulated from it.
