Описание: This book presents an answer to the question of why modern legal institutions and the idea of citizenship are important for leading a free life. The majority of views in political and legal philosophy regard the law merely as a useful instrument, employed to render our lives more secure and to enable us to engage in cooperate activities more efficiently. The view developed here defends a non-instrumentalist alternative of why the law matters. It identifies the law as a constitutive feature of our identities as citizens of modern states. The constitutivist argument rests on the (Kantian) assumption that a person’s practical identity (its normative self-conception as an agent) is the result of its actions. The law co-constitutes these identities because it maintains the external conditions that are necessary for the actions performed under its authority. Modern legal institutions provide these external prerequisites for achieving a high degree of individual self-constitution and freedom. Only public principles can establish our status as individuals who pursue their life plans and actions as a matter of right and not because others contingently happen to let us do so. The book thereby provides resources for a reply to anarchist challenges to the necessity of legal ordering.

Описание: Moral theories can be distinguished, not only by the answers they give, but also by the questions they ask. Utilitarianism's central commitment is to the promotion of well-being, impartially considered. This commitment shapes utilitarianism in a number of ways. If scarce resources should be directed where they will best promote well-being, and if theoretical attention is a scarce resource, then moral theorists should focus on topics that are most important to the future promotion of well-being. A theme of this Element is that, as times change, the priorities (both practical and theoretical) of utilitarianism also change. Questions that were once theoretical curiosities move centre stage. And themes from earlier utilitarians that have become unfashionable may come to the fore again. Utilitarianism is a living tradition, not an abstract set of timeless principles or a purely historical artefact.

Описание: This guide offers something new among texts elucidating the ethical theory known as Utilitarianism. Intended primarily for students ready to dig deeper into moral philosophy, it examines, in a dialectical and reader-friendly manner, a set of normative principles and a set of evaluative principles leading to what is perhaps the most defensible version of Utilitarianism. With the aim of laying its weaknesses bare, each principle is serially introduced, challenged, and then defended. The result is a battery of stress tests that shows with great clarity not only what is attractive about the theory, but also where its problems lie. It will fascinate any student ready for a serious investigation into what we ought to do and what is of value.

Описание: Jeremy Bentham coined the term 'utilitarian' in 1781, but the idea of 'utility' as a value, goal or principle in political, moral or economic life has a long and rich history. The Bloomsbury Encyclopedia of Utilitarianism captures the complex developmental history and the multi-faceted character of utilitarianism in its various contexts and forms more completely than any previous source. Studies of utilitarianism hitherto have been notably compartmentalised, focusing on utilitarian ethics, or the socio-political utilitarianism epitomized in Benthamism, or the genesis of Austrian jurisprudence, but never making these various aspects available for comparative study within a single work. The Encyclopedia includes entries on the authors and texts that are recognised as having built the tradition of utilitarian thinking, as well as on the issues and critics that have arisen at every stage of the development of that tradition. Academics and researchers in search of fresh juxtapositions of issues and arguments will welcome this unique reference work.
