Описание: Welfare state professionals decide or establish premises as to whom will receive what, in what manner, when and how much, and when enough is enough. They control who passes through the gates of the welfare state. This book provides an in-depth understanding of the phenomenon of discretion. It shows why the delegation of discretionary powers to professionals in the front-line of the welfare state is both unavoidable and problematic. Extensive use of discretion can threaten the principles of the rule of law and relinquish democratic control over the implementation of laws and policies. The book introduces an understanding of discretion that adds an epistemic dimension (discretion as a mode of reasoning) to the common structural understanding of discretion (an area of judgment and decision). Accordingly, it distinguishes between structural and epistemic measures of accountability. The aim of the former is to constrain discretionary spaces or the behavior within them while the aim of the latter is to improve the quality of discretionary reasoning. This text will be of key interest to scholars and students in the fields of applied philosophy, public policy and public administration, welfare state research, and the sociology of professions.

Описание: At a time when the future of the welfare state is the object of heated debate in many European countries, this edited collection explores the relationship between this institution and social rights. Structured around the themes of the politics of social rights, questions of equality and social exclusion/inclusion, and the increasing impact of market imperatives on social policy, the book explores the effect of transformations in the welfare state upon social rights and their underlying rationalities and logics. Written by a group of international scholars, many of the essays discuss a number of urgent and topical issues within social policy, including: the social rights of asylum seekers; the increasing marketization and consumerization of public welfare services; the care of the elderly; and the obligation to work as a condition of access to welfare benefits. International in its scope, and interdisciplinary in its approach, this collection of essays will appeal to scholars and students working in the fields of law and socio-legal studies, sociology, social policy, and politics. It will also be of interest to policy makers and all those engaged in the debate over the future of the welfare state and social rights.

Описание: This volume addresses the contentious and topical issue of aboriginal self-government over child welfare. Using case studies from Australia and Canada, it discusses aboriginal child welfare in historical and comparative perspectives and critically examines recent legal reforms and changes in the design, management and delivery of child welfare services aimed at securing the 'decolonization' of aboriginal children and families. Within this context, the author identifies the limitations of reconciling the conflicting demands of self-determination and sovereignty and suggests that international law can provide more nuanced and culturally sensitive solutions. Referring to the UN Declaration on the Rights of Indigenous Peoples, and the UN Convention on the Rights of the Child, it is argued that the effective decolonization of aboriginal child welfare requires a journey well beyond the single issue of child welfare to the heart of the debate over self-government, self-determination and sovereignty in both national and international law.

Описание: Residential care and treatment for children and youth remain ubiquitous across Canada in spite of frequent critiques and an ideology of constructing group care as a last resort. In the first book of its kind, Dr. Kiaras Gharabaghi argues that the absence of a unifying theory or conceptual idea(s) pursuant to residential care and treatment perpetuate dynamics of mediocrity and complacency toward inadequate standards and practices. Drawing on organizational examples from across Canada, Gharabaghi re-constructs the possibilities for this form of care as a space for healing, growth, and the promotion of autonomy for young people. This well-timed resource offers the child and youth services community a positive, constructive, and revolutionary framework for residential care and treatment that is fundamentally based on a partnership between caregivers and young people, their families, neighbourhoods, and communities. Dr. Gharabaghi’s sophisticated and provocative analysis of the system’s key issues is essential reading for students, practitioners, and educators in the field of child and youth care and in the human services more broadly.Features:explores residential care and treatment with a focus on the needs of unique populations, such as black youth, Indigenous youth, and young people impacted by developmental disability or neurodevelopmental challengesemphasizes the voices and participation of young people with lived experience in residential care and treatmentwritten in a uniquely Canadian context, but its theoretical elements draw on residential care in the United States, Germany, South Africa, and elsewhere

Описание: What is it like to grow up in an orphanage? What do residents themselves have to say about their experiences? Are there ways that orphanages can be designed to meet children's developmental needs and to provide them with necessities they are unable to receive in their home communities? In this book, detailed observations of children's daily life in a Cambodian orphanage are combined with follow-up interviews of the same children after they have grown and left the orphanage. Their thoughtful reflections show that the quality of care children receive is more important for their well-being than the site in which they receive it. Life in a Cambodian Orphanage situates orphanages within the social and political history of Cambodia, and shows that orphanages need not always be considered bleak sites of deprivation and despair. It suggests best practices for caring for vulnerable children regardless of the setting in which they are living.

From 1994 to 2006, William F. Schulz headed Amnesty International USA. During this time, he and the organization confronted some of the greatest challenges to human rights, including genocides in Rwanda, Bosnia, and Sudan; controversies over the prison camp at Guantanamo Bay, Cuba, and the use of torture by the United States after 9/11; as well as growing concern about inequities in the American justice system, from police misconduct to the death penalty. Drawing upon his encounters with tyrants, the inspiration of brave human rights heroes, and collaborations with celebrities ranging from Patrick Stewart to Salma Hayek, Schulz uses poignant narrative and amusing anecdotes to discuss the day-to-day realities of struggling with life-and-death human rights crises. In the process he ducks an assassination threat in Liberia; brings tears to the eyes of the Prime Minister of Northern Ireland; and bests America’s self-described “toughest sheriff” on Bill Maher’s Politically Incorrect. Full of reflection as well as action, Reversing the Rivers provides Schulz with the opportunity to address profound philosophical questions, such as “What is the nature of evil?”; “How do we foster the ‘better angels of our nature’?” “When may we use force to stop people from using force?” “Is the prohibition on torture as simple as it seems?” and “What’s wrong with an eye for an eye?” Most important, in an eloquent concluding chapter, he answers the quandary most frequently posed to him during his years at Amnesty, “Given all the horrors in the world you see day after day, how do you retain any hope at all in humanity?”
