Описание:

Arguing that law must be looked at holistically, this book investigates the 'hidden gender' of the so-called neutral or objective legal principles that structure the law addressing violence against women. Adopting an explicitly feminist perspective, it investigates how legal responses to violence against women presuppose, maintain and perpetuate a certain context that may not in fact reflect women's experiences.

Carline and Easteal draw upon relevant legislation, case law and secondary studies from a range of territories, including Australia, England and Wales, the United States, Canada and Europe, to contextualize and critique different policy responses. They go on to examine the potential and limits of law, making recommendations for best practice models of policymaking and law reform.

Aiming to help improve government, community and legal responses to women who experience violence, Shades of Grey - Domestic and Sexual Violence Against Women: Law Reform and Society will assist law-makers, academics, policymakers and a wider audience in understanding the complexities of violence against women.

Описание: Rape and the Law: Historical and Contemporary Perspectives examines the legal history of rape to understand why modern audiences continue to disagree about the nature of the crime, why society as a whole often fails to believe and support victims, and how we can change our understanding of and approach to the crime. The volume begins with an examination of American rape law, explaining the historical sources of the law and analyzing the meanings and ideas embedded in the conventional definition of rape. The second part explores how the conventional law of rape affects attitudes about autonomy and accountability, gives priority to violence over other forms of communication, and imposes risks and burdens to all. It also addresses the risks and realities of false accusations. Finally, the book proposes a revised understanding of the legal basis of rape, reconceiving the legal right and injury involved and advancing a positive consent standard.Rape and the Law is part of the Cognella Series on Family and Gender-Based Violence, an interdisciplinary collection of textbooks featuring cross-cultural perspectives, cutting-edge strategies and interventions, and timely research on family and gender-based violence.

Описание:

Violence against Indigenous women in Canada is an ongoing crisis, with roots deep in the nation s colonial history. Despite numerous policies and programs developed to address the issue, Indigenous women continue to be targeted for violence at disproportionate rates. What insights can literature contribute where dominant anti-violence initiatives have failed? Centring the voices of contemporary Indigenous women writers, this book argues for the important role that literature and storytelling can play in response to gendered colonial violence.

Indigenous communities have been organizing against violence since newcomers first arrived, but the cases of missing and murdered women have only recently garnered broad public attention. "Violence Against Indigenous Women" joins the conversation by analyzing the socially interventionist work of Indigenous women poets, playwrights, filmmakers, and fiction-writers. Organized as a series of case studies that pair literary interventions with recent sites of activism and policy-critique, the book puts literature in dialogue with anti-violence debate to illuminate new pathways toward action.

With the advent of provincial and national inquiries into missing and murdered Indigenous women and girls, a larger public conversation is now underway. Indigenous women s literature is a critical site of knowledge-making and critique. "Violence Against Indigenous Women" provides a foundation for reading this literature in the context of Indigenous feminist scholarship and activism and the ongoing intellectual history of Indigenous women s resistance. Описание: Each year, millions of women throughout the world experience violence and abuse at the hands of their intimate partner. Abusers coercively control them by using a variety of tactics ranging from physical or sexual violence to emotional or psychological abuse. An additional tactic often used includes financial abuse in which the abuser controls the money in the family, exploits the victim's financial standing, and interrupts her efforts to be self-sufficient. The impact of financial abuse can leave women financially trapped in the relationship with limited financial management skills, knowledge, or self-confidence. Indeed, survivors often mention financial barriers as a top reason for keeping them trapped by the abuser in the relationship.   Curiously, little of the research on domestic violence has sought to either fully understand the impact of financial abuse or to determine which intervention strategies are most effective for the financial empowerment of survivors. Building Financial Empowerment for Survivors of Domestic Violence aims to address this critical knowledge gap by providing those who work with survivors of domestic violence with practical knowledge on how to empower the financial well-being and stability of survivors. Specifically, every practitioner, human service provider, criminal justice practitioner, financial manager, and corporate supervisor should be screening the women they encounter for economic abuse, and when such abuse is found, they should work with the women toward developing financial safety plans and refer survivors to financial empowerment programs to assist survivors to become free from abuse.

Описание: This book explores the prosecution of wartime sexual violence in international criminal law and asks what the juridicalisation of gender-based violence signifies for women. The book explores the portrayal of the various gendered identities that surface in armed conflict and it asks whether the law is capable of reflecting these in subsequent judgements. Focusing on the International Criminal Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda as well as subsequent developments in the International Criminal Court, the book shows how the tribunals have delivered landmark jurisprudence in the area of sexual violence against women and provided a legacy for how gender justice is incorporated into international law. However, Daniela Nadj argues that in the relevant cases there is a tendency to depict women in monolithic fashion with little agency or sense of identity beyond their ethnicity. By bringing to the surface the complexity and multi-faceted gendered identities in wartime, the book calls for a reconceptualisation of notions of femininity in armed conflict.
