Описание:
In the third edition of his classic work, revised extensively and updated to include recent developments on the international scene, Jack Donnelly explains and defends a richly interdisciplinary account of human rights as universal rights. He shows that any conception of human rights—and the idea of human rights itself—is historically specific and contingent.
Since publication of the first edition in 1989, Universal Human Rights in Theory and Practice has justified Donnelly’s claim that "conceptual clarity, the fruit of sound theory, can facilitate action. At the very least it can help to unmask the arguments of dictators and their allies."
Описание: A global history of human rights in a world of nations that grant rights to some while denying them to othersOnce dominated by vast empires, the world is now divided into some 200 independent countries that proclaim human rights-a transformation that suggests that nations and human rights inevitably develop together. But the reality is far more problematic, as Eric Weitz shows in this compelling global history of the fate of human rights in a world of nation-states. Through vivid histories from virtually every continent, A World Divided describes how, since the eighteenth century, nationalists have established states that grant human rights to some people while excluding others, setting the stage for many of today's problems, from the refugee crisis to right-wing nationalism.
Only the advance of international human rights will move us beyond a world divided between those who have rights and those who don't.

Описание:
Rights are part of our everyday moral and political vocabulary. Yet while few would deny that rights are important, there is a great deal of disagreement about just how valuable rights are and what their proper limits ought to be. For example, some scholars and practitioners maintain that human rights are valuable because they lay down a framework of protection, while at the same time leaving people ample room to lead their lives as they see fit. They are not just another way of life, but instead set the boundaries to what government can or cannot do. Others, however, hold that, while important, rights are not neutral between different ways of life and hence cannot tell us what to do when different ways of life conflict. This collection breaks new ground by tackling such questions head on. The issues it covers are some of the most vital that we face today. Their relevance to contemporary social and political debates cannot be overstated. The collection should appeal to political philosophers, lawyers, human rights activists and advanced undergraduate and graduate students in the arts, humanities and social sciences.
This book was published as a special issue of Critical Review of International, Social and Political Philosophy.

Описание: Contemporary human rights discourses problematically co-opt disabled bodies as `evidence` of harms done under capitalism, war, and other forms of conflict, while humanitarian non-governmental organizations often use disabled bodies to generate resources for their humanitarian projects. It is the connection between civil rights and human rights.

Описание: Who should receive asylum? Traditionally, asylum has been limited to people fearing persecution, but should it be extended to those fleeing civil wars, severe poverty, and other serious harm? Matthew Price defends the focus on persecution, arguing that granting asylum expresses political values by condemning states for mistreating their citizens.

Описание:
The fall of communism in the late 1980s and the end of the Cold War seemed to signal a new international social order built on pluralist democracy, the rule of law, and universal human rights. But the window of opportunity for creating this more just, more equal, and more secure world slammed shut just as quickly as it opened. Rather than celebrate the triumph of democracy over autocracy, or political freedom over totalitarian rule, the West exulted in the victory of capitalism over communism. Neoliberal policies of deregulation and privatization that minimized the role of the state were imposed on the transitional societies of Central and Eastern Europe, as well as economically weak and politically fragile nations in Africa, Asia, and Latin America. Twenty-five years later, the world reaps the fruits of that market-driven state foundation: inequality; poverty; global economic, food, financial, social, and ecological crises; transnational organized crime and terrorism; proliferating weapons; fragile states. Human Rights or Global Capitalism is not simply concerned with the success or failure of neoliberal policies per se or judging whether they are good or bad. Rather, it examines the application of those policies from a human rights perspective and asks whether states, by outsourcing to the private sector many services with a direct impact on human rights—education, health, social security, water, personal liberty, personal security, equality—abdicate their responsibilities to uphold human rights and thereby violate international human rights law. Manfred Nowak explores these examples and outlines the ways in which neoliberal policies contravene the obligations of states to protect the human rights of their people.

Описание: The argument is made that both these duties can only be adequately defined and allocated if we adopt the perspective of duties, as the predominant perspective of rights either does not recognize them to be duties at all or else leaves their content and allocation indefinite.
