Why does society punish criminals? What political principles underlie the determination of punishment to suit the crime? In Founding the Criminal Law, Pestritto studies policies concerning crime and punishment in early America to better understand political thought during the founding era, bringing fresh insights to modern debates about the consequences of lawbreaking.
Basing his research on original government documents, state constitutions, the arguments of America's founders, and the writings of such influential reformers as William Penn, William Bradford, and Thomas Jefferson, Pestritto analyzes the complex mix of punishment philosophies at work in early America. He shows how the political principles that guided America's founders in their selection of criminal punishments contribute to the current debate over crime and justice in America. Impressive and interdisciplinary, Founding the Criminal Law holds particular interest for political scientists, American and legal historians, and criminal justice scholars.
Описание: This book looks at the interplay between criminal and other branches of public law pursuing similar objectives (referred to as ‘quasi-criminal law’). The need for clarifying the concepts and the interlink between criminal and quasi-criminal enforcement is a topic attracting a lot of discussion and debate both in academia and practice across Europe (and beyond). This volume adds to this debate by bringing to light the substantive and procedural problems stemming from the current parallel or dual use of the different enforcement systems. The collection draws on expertise from academia, practice and policy; its high-quality analysis will appeal to scholars, practitioners and policymakers alike.
Описание: This book consists of a fundamental deconstruction and reconstruction of the key concepts of Criminology and The Sociology of Law, providing a coherent expression of the relationships between these newly constructed concepts and thus a radically new statement of the relationship between society, crime and the law.

Anyone who wants to understand how abortion has been treated historically in the Western legal tradition must first come to terms with two quite different but interrelated historical trajectories. On one hand, there is the ancient Judeo-Christian condemnation of prenatal homicide as a wrong warranting retribution; on the other, there is the juristic definition of "crime" in the modern sense of the word, which distinguished the term sharply from "sin" and "tort" and was tied to the rise of Western jurisprudence. To find the act of abortion first identified as a crime in the West, one has to go back to the twelfth century, to the schools of ecclesiastical and Roman law in medieval Europe.
In this book, Wolfgang P. M?ller tells the story of how abortion came to be criminalized in the West. As he shows, criminalization as a distinct phenomenon and abortion as a self-standing criminal category developed in tandem with each other, first being formulated coherently in the twelfth century at schools of law and theology in Bologna and Paris. Over the ensuing centuries, medieval prosecutors struggled to widen the range of criminal cases involving women accused of ending their unwanted pregnancies. In the process, punishment for abortion went from the realm of carefully crafted rhetoric by ecclesiastical authorities to eventual implementation in practice by clerical and lay judges across Latin Christendom. Informed by legal history, moral theology, literature, and the history of medicine, M?ller’s book is written with the concerns of modern readers in mind, thus bridging the gap that might otherwise divide modern and medieval sensibilities.

Описание: The European Arrest Warrant (‘EAW’), the cornerstone of European criminal law, is twenty years old. This collection brings together the leading commentators in the field to assess its merits, successes and suggest improvements. Taking a holistic approach, it looks at the EAW from all the different perspectives of its operation. Discussions range from fundamental rights, to constitutional issues and questions of national diversity, and to the external dimension of the EAW. This is an important assessment of the EAW, destined to become the point of reference in the field.
