Описание: Over the last quarter of a century a new system of global criminal justice has emerged; national judges have become bolder in prosecuting crimes committed abroad, special tribunals have been able to target national leaders as well as their henchmen, and a permanent International Criminal Court has been established.
Описание: This is the story of Robert Rice Howard (1832–1906), the man known as Nosey Bob. It is also an important chapter in the story of the changing attitudes towards capital punishment in Australia, as the country transformed from generally enthusiastic spectators at executions into campaigners for the abolition of the death penalty. These interconnected stories are told through the men, and the one woman, who met Nosey Bob under the worst possible circumstances between his first employment by the Department of Justice in 1876 and his retirement as the executioner for New South Wales in 1904.Once a household name, Nosey Bob was the most infamous public servant in Sydney: a noseless hangman who sparked fear and fascination everywhere he went. Howard has only ever been cast as an extra in someone else's play, making frightening appearances in a felon's final scene on the gallows. Here, for the first time, he has taken the lead.

Although service outsourcing has spread throughout Canada’s prisons and jails, into its police, courts, and national security institutions, and along the border in recent decades, the expanding scope and pace of corporate involvement in criminal justice functions has not yet been closely investigated. Changing of the Guards provides a detailed assessment of privatization and private influence across the twenty-first-century Canadian criminal justice system. It illuminates the many consequences of public–private arrangements for law and policy, transparency, accountability, the administration of justice, equity, and the public. This trenchant analysis raises issues that are relevant in Canada and abroad.

Описание: Focusing contemporary democratic theory on the neglected topic of punishment, Punishment, Participatory Democracy, and the Jury argues for increased civic engagement in criminal justice as an antidote to the American penal state. Albert W. Dzur considers how the jury, rather than merely expressing unreflective public opinion, may serve as a participatory institution that gathers and utilizes citizens' juridical capabilities. In doing so, the book resists trends in criminal justice scholarship that blame increases in penal severity on citizen participation and rejects political theorists' longstanding skepticism of lay abilities. Dzur distinguishes constructive citizen involvement that takes responsibility for public problems from a mass politics mobilized superficially around single issues. This more positive view of citizen action, which was once a major justification for the jury trial, is now also manifest in the restorative justice movement, which has incorporated lay people into community boards and sentencing circles. Both jury trials and restorative justice programs, Dzur explains, are examples of rational disorganization, in which lay citizen action renders a process less efficient yet also contributes valuable qualities such as attunement, reflectiveness, and full-bodied communication. While restorative justice programs and participatory policy forums such as citizens' juries have become attractive to reformers, traditional juries have suffered a steep and troubling decline. Punishment, Participatory Democracy, and the Jury advocates a broader role for jurors in the criminal courts and more widespread use of jury trials. Though no panacea for a political culture grown too comfortable with criminalization and incarceration, participatory institutional designs that rationally disorganize punishment practices and slow down criminal justice can catalyze civic responsibility and public awareness about the need to find alternative paths forward for America's broken penal system.
Описание: Winner of the 2018 Book Award from the American Society of Criminology's Division of Critical Criminology and Social Justice Winner of the 2018 Book of the Year Award from the American Society of Criminology's Division on Women and Crime After decades of the American "war on drugs" and relentless prison expansion, political officials are finally challenging mass incarceration. Many point to an apparently promising solution to reduce the prison population: addiction treatment. In Addicted to Rehab, Bard College sociologist Allison McKim gives an in-depth and innovative ethnographic account of two such rehab programs for women, one located in the criminal justice system and one located in the private healthcare system—two very different ways of defining and treating addiction. McKim's book shows how addiction rehab reflects the race, class, and gender politics of the punitive turn. As a result, addiction has become a racialized category that has reorganized the link between punishment and welfare provision. While reformers hope that treatment will offer an alternative to punishment and help women, McKim argues that the framework of addiction further stigmatizes criminalized women and undermines our capacity to challenge gendered subordination. Her study ultimately reveals a two-tiered system, bifurcated by race and class.

Описание: Since 1993, crime in the United States has fallen to historic lows, seeming to legitimize the country's mix of welfare reform and mass incarceration. The Upper Limit explains how this unusual mix came about, examining how, beginning in the 1970s, declining living standards for the poor have defined social and penal policy in the United States, making welfare more restrictive and punishment harsher. Fran ois Bonnet shows how low-wage work sets the upper limit of social and penal policy, where welfare must be less attractive than low-wage work and criminal life must be less attractive than welfare. In essence, the living standards of the lowest class of workers in a society determine the upper limit for the generosity of welfare and for the humanity of punishment in that society. The Upper Limit explores the local consequences of this punitive adjustment in East New York, a Brooklyn neighborhood where crime fell in the 1990s. Bonnet argues that no meaningful penal reform can happen unless living standards and the minimum wage rise again. Enlightening and provocative, The Upper Limit provides a comprehensive theory of the evolution of social and penal policy.
