Описание: In the last two decades there has been positive change in how the Canadian legal system defines Aboriginal and treaty rights. Yet even after the recognition of those rights in the Constitution Act of 1982, the legacy of British values and institutions as well as colonial doctrine still shape how the legal system identifies and interprets Aboriginal and treaty rights. The eight essays in Aboriginal and Treaty Rights in Canada focus on redressing this bias. All of them apply contemporary knowledge of historical events as well as current legal and cultural theory in an attempt to level the playing field. The book highlights rich historical information that previous scholars may have overlooked. Of particular note are data relevant to better understanding the political and legal relations established by treaty and the Royal Proclamation of 1763. Other essays include discussion of such legal matters as the definition of Aboriginal rights and the privileging of written over oral testimony in litigation.

Описание:

This book shows how human rights became the primary language for social change in Canada and how a single decade became the locus for that emergence. The author argues that the 1970s was a critical moment in human rights history one that transformed political culture, social movements, law, and foreign policy. "Human Rights in Canada" is one of the first sociological studies of human rights in Canada. It explains that human rights are a distinct social practice, and it documents those social conditions that made human rights significant at a particular historical moment.
A central theme in this book is that human rights derive from society rather than abstract legal principles. Therefore, we can identify the boundaries and limits of Canada s rights culture at different moments in our history. Until the 1970s, Canadians framed their grievances with reference to Christianity or British justice rather than human rights. A historical sociological approach to human rights reveals how rights are historically contingent, and how new rights claims are built upon past claims. This book explores governments tendency to suppress rights in periods of perceived emergency; how Canada s rights culture was shaped by state formation; how social movements have advanced new rights claims; the changing discourse of rights in debates surrounding the constitution; how the international human rights movement shaped domestic politics and foreign policy; and much more. In addition to drawing on secondary literature in law, history, sociology, and political science, this study looked to published government documents, litigation and case law, archival research, newspapers, opinion polls, and materials produced by non-governmental organizations. Описание: With the adoption of the United Nations Convention on the Rights of the Child (1989), commentators began to situate the evolution of the status of children within the context of the ""property to persons"" trajectory that other human rights stories had followed. In the first edition of A Question of Commitment, editors R. Brian Howe and Katherine Covell provided a template of analysis for understanding this evolution. They identified three overlapping stages of development as children transitioned from being regarded as objects to subjects in their own right: social laissez-faire, paternalistic protection, and children's rights. In the social laissez-faire stage, children are regarded as objects, and largely as the property of parents. In the paternalistic protection stage, children are seen as vulnerable and in need of protection. The children's rights stage lays emphasis on children as rights-bearers, as individuals in their own right with entitlements.

In this second edition, new essays assess the extent to which children's rights have been incorporated into their respective areas of policy and law. The authors draw conclusions about what the situation reveals about the status of children in Canada. Overall, many challenges remain on the pathway to full recognition and citizenship.

Описание: From 1948 to 1966, the United Nations worked to create a common legal standard for human rights protection around the globe. Resisting Rights analyzes the Canadian government’s changing policy toward this endeavour from the 1940s to the 1970s, exploring how developments in international relations and evolving cultural attitudes within Canadian society created pressure on the federal government to overcome its initial reluctance to be bound by international human rights law. This timely study situates current policies within their historical context and debunks the myth that Canada has been at the forefront of international human rights policy since its inception.

Описание:

This book tells the story of a First Nation’s single-minded quest for justice. In 1958, the federal government leased a third of the small Musqueam Reserve in Vancouver to an exclusive golf club at far below market value. When the band members discovered this in 1970, they initiated legal action. Their tenacity led to the 1984 decision of the Supreme Court of Canada in Guerin v. The Queen.

In Guerin, the Court held that the government has a fiduciary duty towards Indigenous peoples – an obligation to act in their best interests. This landmark decision is explored in this book, written by an Aboriginal rights lawyer who served as one of the legal counsel for the Musqueam and argued on their behalf all the way to the highest court. Jim Reynolds provides an in-depth analysis, considering the context, the case and decision, and the major impact that Guerin had on Canadian law, politics, and society.

The Guerin case changed the relationship between governments and Indigenous peoples from one of wardship to one based on legal rights. It was a seismic decision with implications that resonate today, not only in Canada but also in other Commonwealth countries.

Описание: What does reconciliation and truth-telling look like, and how do we as a nation find justice for Indigenous people? In this deeply personal work, Inala Cooper shares stories of her family to show the impact of colonisation on the lives of Aboriginal people from the 1940s to now. She reveals the struggles faced by her Elders and contrasts them with the freedoms she comes across as an Aboriginal woman today. Speaking only from lived experience, Inala examines racism, privilege, and how deeply personal is ones identity. Her stories illustrate the complexities of identifying as Aboriginal and the importance of community in an increasingly individualist world. Exploring the impacts of major events throughout her life, Inala reflects on how human rights are breached and defended. She examines reconciliation and the need to share wealth and power, and the importance of truth-telling and justice. In finding her place as an advocate and activist for social justice, Inala is supported by her family, her ancestors, community and the academy. It is these supports that help her challenge racist and outdated notions of what it means to be Indigenous, sovereign and self-determined, and to uphold the principles of justice. The thought-provoking stories in this book surface more questions than the necessary answers. But Inala brings us to her home as she weaves together her stories, the country shes connected to, and the elements that shape her path--none so prevalent as Marrul: the changing wind.
