Since 9/11 and the onset of the “war on terror,” the principal challenge confronting liberal democracies has been to balance freedom with security and individual with collective rights. In Defence of Principles sheds new light on the evolution of human rights norms in liberal democracies by charting the activism of four Canadian NGOs on issues of refugee rights, hate speech, and the death penalty, including their use of difficult, often controversial legal cases as platforms to assert human rights principles and shape judicial policy-making.
Although human rights principles are often spoken of in absolute terms, this book reminds us that they are never certain – even in countries that have a vibrant civil society, a long tradition of rule of law, and a judiciary that possesses the constitutional authority to engage in judicial review. The struggles of these NGOs reveal not only the fragility but also the resilience of ideas about rights in liberal democracies.

Описание: This clear and compelling text offers a vastly different approach to human rights. Arguing that not only are human rights universal, but so are the obligations to protect these rights, Mark Gibney concludes that there is a moral and legal imperative to return to the universal principles human rights were founded on.

In a global economy, multinational companies often operate in jurisdictions where governments are either unable or unwilling to uphold even the basic human rights of their citizens. The expectation that companies respect human rights in their own operations and in their business relationships is now a business reality that corporations need to respond to.
Business and Human Rights: From Principles to Practice is the first comprehensive and interdisciplinary textbook that addresses these issues. It examines the regulatory framework that grounds the business and human rights debate and highlights the business and legal challenges faced by companies and stakeholders in improving respect for human rights, exploring such topics as:
the regulatory framework that grounds the business and human rights debate
challenges faced by companies and stakeholders in improving human rights
industry-specific human rights standards
current mechanisms to hold corporations to account
future challenges for business and human rights
With supporting case studies throughout, this text provides an overview of current themes in the field and guidance on practical implementation, demonstrating that a thorough understanding of the human rights challenges faced by business is now vital in any business context.
Описание: The book will appeal to academics with interests in the use of weapons within different legal regimes, including arms control treaties, humanitarian, human rights and criminal law. Furthermore, the book is addressed at policymakers and public authorities who encounter less-lethal weapons in practice.
Описание: With the adoption of the United Nations Convention on the Rights of the Child (1989), commentators began to situate the evolution of the status of children within the context of the ""property to persons"" trajectory that other human rights stories had followed. In the first edition of A Question of Commitment, editors R. Brian Howe and Katherine Covell provided a template of analysis for understanding this evolution. They identified three overlapping stages of development as children transitioned from being regarded as objects to subjects in their own right: social laissez-faire, paternalistic protection, and children's rights. In the social laissez-faire stage, children are regarded as objects, and largely as the property of parents. In the paternalistic protection stage, children are seen as vulnerable and in need of protection. The children's rights stage lays emphasis on children as rights-bearers, as individuals in their own right with entitlements.
In this second edition, new essays assess the extent to which children's rights have been incorporated into their respective areas of policy and law. The authors draw conclusions about what the situation reveals about the status of children in Canada. Overall, many challenges remain on the pathway to full recognition and citizenship.
Описание: The wars on terror, economic crises, climate change, and humanitarian emergencies have challenged decision makers to institute new measures to maintain security. Foreign policy analysts tend to view these decisions as being divorced from ethics, but is this the case? Unsettled Balance, the first rigorous and sustained analysis of security and ethics in the post-9/11 world, shows that ethical arguments about rights, obligations, norms, and values have played a profound role in Canadian foreign policy and international relations, from debates on the “responsibility to protect” as a practice to the militarization of humanitarian aid. Описание: The European Convention on Human Rights is one of the world's most important and influential human rights documents. It owes its value mainly to the European Court of Human Rights, which applies the Convention rights in individual cases. This book offers insight into the concepts and principles that are key to understanding the European Convention and the Court's case law. It explains how the Court approaches its cases and its decision-making process, illustrated by numerous examples taken from the Court's judgments. Core issues discussed include types of Convention rights (such as absolute rights); the structure of the Court's Convention rights review; principles and methods of interpretation (such as common-ground interpretation and the use of precedent); positive and negative obligations; vertical and horizontal effect; the margin of appreciation doctrine; and the requirements for the restriction of Convention rights.
