Universal human rights standards were adopted in 1948, but in the 1970s and 1980s, violent dictatorships in Argentina and Chile flagrantly defied the new protocols. Chilean general Augusto Pinochet and the Argentine military employed state terrorism in their quest to eradicate Marxism and other forms of “subversion.” Pinochet constructed an iron shield of impunity for himself and the military in Chile, while in Argentina, military pressure resulted in laws preventing prosecution for past human rights violations. When democracy was reestablished in both countries by 1990, justice for crimes against humanity seemed beyond reach.
Thomas C. Wright examines how persistent advocacy by domestic and international human rights groups, evolving legal environments, unanticipated events that impacted public opinion, and eventual changes in military leadership led to a situation unique in the world—the stripping of impunity not only from a select number of commanders of the repression but from all those involved in state terrorism in Chile and Argentina. This has resulted in trials conducted by national courts, without United Nations or executive branch direction, in which hundreds of former repressors have been convicted and many more are indicted or undergoing trial.

This approach proves to be valid for the religious pluralism of the Habsburg Empire, where self-professed confessional identity could not be delimited either within a crown land or within a specific ethnic milieu. The studies in this volume explore just such shared practices and experiences encompassing a larger collection of territories within the Monarchy by focusing on those areas that contained large numbers of Christians whose faith and rituals derived from Byzantium rather than Rome, that is, Eastern Orthodox and Greek Catholics (Uniates). The volume also aims to provide a corrective in Eastern Christian studies by looking outside Russia and Greece at the often hybrid practices and cultural and religious experiences of Europes westernmost Orthodox and Byzantine Catholic faithful. From the civil rights movement of the 1950s to the “culture wars” of North America, commentators have identified the partisans bent on pursuing different “rights” claims. When religious identity surfaces as a key determinant in how the pursuit of rights occurs, both “the religious right” and “liberal” believers remain the focus of how each contributes to making rights demands. How Orthodox Christians in North America have navigated the “rights revolution,” however, remains largely unknown. From the disagreements over the rights of the First Peoples of Alaska to arguments about the rights of transgender persons, Orthodox Christians have engaged an anglo-American legal and constitutional rights tradition. But they see rights claims through the lens of an inherited focus on the dignity of the human person. In a pluralistic society and culture, Orthodox Christians, both converts and those with family roots in Orthodox countries, share with non-Orthodox fellow citizens the challenge of reconciling conflicting rights claims. Those claims do pit “religious liberty” rights claims against perceived dangers from outside the Orthodox Church. But internal disagreements about the rights of clergy and people within the Church accompany the Orthodox Christian engagement with debates over gender, sex, and marriage as well as expanding political, legal, and human rights claims. Despite their small numbers, North American Orthodox remain highly visible and their struggles influential among the more than 280 million Orthodox worldwide.
