Описание:

The New Rhetoric is founded on the idea that since “argumentation aims at securing the adherence of those to whom it is addressed, it is, in its entirety, relative to the audience to be influenced,” says Cha?m Perelman and L. Olbrechts-Tyteca, and they rely, in particular, for their theory of argumentation on the twin concepts of universal and particular audiences: while every argument is directed to a specific individual or group, the orator decides what information and what approaches will achieve the greatest adherence according to an ideal audience. This ideal, Perelman explains, can be embodied, for example, in God, in all reasonable and competent men, in the man deliberating or in an elite.” Like particular audiences, then, the universal audience is never fixed or absolute but depends on the orator, the content and goals of the argument, and the particular audience to whom the argument is addressed. These considerations determine what information constitutes facts and reasonableness and thus help to determine the universal audience that, in turn, shapes the orators approach.

The adherence of an audience is also determined by the orators use of values, a further key concept of the New Rhetoric. Perelmans treatment of value and his view of epideictic rhetoric sets his approach apart from that of the ancients and of Aristotle in particular. Aristotles division of rhetoric into three genres–forensic, deliberative, and epideictic–is largely motivated by the judgments required for each: forensic or legal arguments require verdicts on past action, deliberative or political rhetoric seeks judgment on future action, and epideictic or ceremonial rhetoric concerns values associated with praise or blame and seeks no specific decisions. For Aristotle, the epideictic genre was of limited importance in the civic realm since it did not concern facts or policies. Perelman, in contrast, believes not only that epideictic rhetoric warrants more attention, but that the values normally limited to that genre are in fact central to all argumentation. Epideictic oratory, Perelman argues, has significant and important argumentation for strengthening the disposition toward action by increasing adherence to the values it lauds.” These values are central to the persuasiveness of arguments in all rhetorical genres since the orator always attempts to establish a sense of communion centered around particular values recognized by the audience.”

Описание:

This volume explores the relation between legal reasoning and logic from both a historical and a systematic perspective. The topics addressed include, among others, conditional legal acts, disjunctions in legal acts, presumptions and conjectures, conflicts of values, J rgensen s Dilemma, the Rhetor s Dilemma, the theory of legal fictions and the categorization of contracts. The unifying problematic of these contributions concerns the conditional structures and, more particularly, the relationship between legal theory and legal reasoning in the context of conditions.

The contributions in this work constitute the first results of the ANR-DFG joint research project "JuriLog" (Jurisprudence and Logic), which aims at fostering the cooperation between legal scholars and philosophers. On the one hand, lawyers and legal scholars have an interest in emphasizing the logical character of legal reasoning. In this respect, the present enquiry examines the question of how logic, especially newer forms of dialogical logic, can be made fruitful as a significant area of philosophy for jurisprudence and legal practice. On the other hand, logicians find in legal reasoning a striving towards clear definitions and inference-procedures that is relevant to their discipline. In order to fully understand such reciprocal relationships, it is necessary to bridge the gap between law, logic and philosophy in contemporary academic research. The essays collected in this volume all work towards this common goal.

The book is divided in three sections. In the first part, the strong relation between Roman Law and logic is explored with respect to the analysis of disjunctive statements in legal acts. The second part focuses on Leibniz s legal theory. The third part, finally, is dedicated to current interactions between law and logic.

Описание: In The Uses of Argument, first published in 1958, Stephen Toulmin proposed a new model for the layout of arguments, with six components: claim, data, warrant, qualifier, rebuttal, backing. Toulmin’s model has been appropriated, adapted and extended by researchers in the fields of speech communications, philosophy and artificial intelligence. The present volume aims to bring together the best contemporary reflection in these fields on the Toulmin model and its current appropriation. The volume includes 24 articles by 27 scholars from 10 countries. All the essays are newly written, have been selected from among those received in response to a call for papers, and have been revised extensively in response to referees’ comments. They are not exegetical but substantive, extending or challenging Toulmin’s ideas in ways that make fresh contributions to the theory of analysing and evaluating arguments. Collectively, they represent the only comprehensive book-length study of the Toulmin model. They point the way to new developments in the theory of argument, including a typology of warrants, a comprehensive theory of defeaters, a rapprochement with formal logic, and a turn from propositions to speech acts as the constituents of argument.

Описание: This monograph proposes a new way of implementing interaction in logic. It also provides an elementary introduction to Constructive Type Theory (CTT). The authors equally emphasize basic ideas and finer technical details. In addition, many worked out exercises and examples will help readers to better understand the concepts under discussion. One of the chief ideas animating this study is that the dialogical understanding of definitional equality and its execution provide both a simple and a direct way of implementing the CTT approach within a game-theoretical conception of meaning. In addition, the importance of the play level over the strategy level is stressed, binding together the matter of execution with that of equality and the finitary perspective on games constituting meaning.According to this perspective the emergence of concepts are not only games of giving and asking for reasons (games involving Why-questions), they are also games that include moves establishing how it is that the reasons brought forward accomplish their explicative task. Thus, immanent reasoning games are dialogical games of Why and How.

Описание:

Understanding Rhetoric: A Guide to Critical Reading and Argumentation is a composition textbook that outlines three essential skills - rhetoric, argument, and source-based writing - geared towards newcomers and advanced students alike. Though comprehensive in its coverage, the book's focus is a simple one: how to move beyond a "gut reaction" while reading to an articulation of what is effective and what is not, while explicitly answering the most important question of "Why?" This text gets at this central concern in two fundamental ways.

First, the text teaches composition as a cumulative process, coaching you how to question, challenge, and expand on not just the readings you hold in your hands, but also how to interrogate the internal processes of writing and thinking. The book's blend of composition methods detail the cross-point of product and process to turn reading and writing from a matter of coming up with answers to questions to learning what type of questions need to be asked in the first place. The "right" questions, the text argues, are fundamentally rhetorical in nature.

Second, the content of the practice-based chapters is framed into a larger mesh of intellectual history to show how the writing and thinking you are doing today is continuous with a long history of writing instruction that goes back to the ancient world. This book provides equal representation from classical and contemporary theory with the recognition that theory cannot be fully grasped without practice, and practice cannot be fully understood without its theoretical antecedent. After all, you can't write "outside the box" until you know where the box is and what it looks like.
