Описание:

Cause Lawyers and Social Movements seeks to reorient scholarship on cause lawyers, inviting scholars to think about cause lawyering from the perspective of those political activists with whom cause lawyers work and whom they seek to serve. It demonstrates that while all cause lawyering cuts against the grain of conventional understandings of legal practice and professionalism, social movement lawyering poses distinctively thorny problems.

The editors and authors of this volume explore the following questions: What do cause lawyers do for, and to, social movements? How, when, and why do social movements turn to and use lawyers and legal strategies? Does their use of lawyers and legal strategies advance or constrain the achievement of their goals? And, how do movements shape the lawyers who serve them and how do lawyers shape the movements?

Описание:

The Clamor of Lawyers explores a series of extended public pronouncements that British North American colonial lawyers crafted between 1761 and 1776. Most, though not all, were composed outside of the courtroom and detached from on-going litigation. While they have been studied as political theory, these writings and speeches are rarely viewed as the work of active lawyers, despite the fact that key protagonists in the story of American independence were members of the bar with extensive practices. The American Revolution was, in fact, a lawyers’ revolution.

Peter Charles Hoffer and Williamjames Hull Hoffer broaden our understanding of the role that lawyers played in framing and resolving the British imperial crisis. The revolutionary lawyers, including John Adams’s idol James Otis, Jr., Pennsylvania’s John Dickinson, and Virginians Thomas Jefferson and Patrick Henry, along with Adams and others, deployed the skills of their profession to further the public welfare in challenging times. They were the framers of the American Revolution and the governments that followed. Loyalist lawyers and lawyers for the crown also participated in this public discourse, but because they lost out in the end, their arguments are often slighted or ignored in popular accounts. This division within the colonial legal profession is central to understanding the American Republic that resulted from the Revolution.

Описание:

The study of cause lawyering has grown dramatically and is now an important field of research in socio-legal studies and in research on the legal profession. The Worlds Cause Lawyers Make: Structure and Agency in Legal Practice adds to that growing body of research by examining the connections between lawyers and causes, the settings in which cause lawyers practice, and the ways they marshal social capital and make strategic decisions.

The book describes the constraints to cause lawyering and the particulars that shape what cause lawyers do and what cause lawyering can be, while also focusing on the dynamic interactions of cause lawyers and the legal, professional, and political contexts in which they operate. It presents a constructivist view of cause lawyering, analyzing what cause lawyers do in their day-to-day work, how they do it, and what difference their work makes. Taken together, the essays collected in this volume show how cause lawyers construct their legal and professional contexts and also how those contexts constrain their professional lives.

Описание:

There can be no justice that is not spatial. Against a recent tendency to despatialise law, matter, bodies and even space itself, this book insists on spatialising them, arguing that there can be neither law nor justice that are not articulated through and in space.

Spatial Justice presents a new theory and a radical application of the material connection between space - in the geographical as well as sociological and philosophical sense - and the law - in the broadest sense that includes written and oral law, but also embodied social and political norms. More specifically, it argues that spatial justice is the struggle of various bodies - human, natural, non-organic, technological - to occupy a certain space at a certain time. Seen in this way, spatial justice is the most radical offspring of the spatial turn, since, as this book demonstrates, spatial justice can be found in the core of most contemporary legal and political issues - issues such as geopolitical conflicts, environmental issues, animality, colonisation, droning, the cyberspace and so on. In order to ague this, the book employs the lawscape, as the tautology between law and space, and the concept of atmosphere in its geological, political, aesthetic, legal and biological dimension.

Written by a leading theorist in the area, Spatial Justice: Body, Lawscape, Atmosphere forges a new interdisciplinary understanding of space and law, while offering a fresh approach to current geopolitical, spatiolegal and ecological issues.

Описание:

This book presents an invaluable collection of essays by eminent scholars from a wide variety of disciplines on the main issues currently confronting legal professions across the world.

It does this through a comparative analysis of the data provided by the reports on 46 countries in its companion volume: Lawyers in 21st-Century Societies: Vol. 1: National Reports (Hart 2020). Together these volumes build on the seminal collection Lawyers in Society (Abel and Lewis 1988a; 1988b; 1989).

The period since 1988 has seen an acceleration and intensification of the global socio-economic, cultural and political developments that in the 1980s were challenging traditional professional forms. Together with the striking transformation of the world order as a result of the fall of the Soviet bloc, neo-liberalism, globalisation, the financialisation of capitalism, technological innovations, and the changing demography of lawyers, these developments underscored the need for a new, comparative exploration of the legal professional field.

This volume deepens the insights in volume 1, with chapters on legal professions in Africa, Latin America, the Islamic world, emerging economies, and former communist regimes. It also addresses theoretical questions, including the sociology of lawyers and other professions (medicine, accountancy), state production, the rule of law, regional bodies, large law firms, access to justice, technology, casualisation, cause lawyering, diversity (gender, race, and masculinity), corruption, ethics regulation, and legal education.

Together with volume 1, it will inform and challenge conceptions of the contemporary profession, and stimulate and support further research.

Defending Rights in Russia: Lawyers, the State, and Legal Reform in the Post-Soviet Era

Описание:

Lawyers often play pivotal roles in building democracies. PamelaJordan’s engaging study of the Russian bar (advokatura) providesa richly textured portrait of how, after the USSR’s collapse, practising lawyers called advocates began to assume new, self-definedroles as contributors to legal reform and defenders of rights inRussia.

Using the historical institutionalism approach as her analyticalframework and drawing from comparative literature on legal professions,Jordan argues that the post-Soviet advokatura as an institution gainedmore, although not complete, autonomy from the state as it struggled toredefine itself as a profession. Advocates formed new bar associationsand law offices and now have a broader range of ways to defendclients’ rights than they did during the Soviet era. Jordansuggests that advocates’ work is supporting the growth of civilsociety and the strengthening of human rights in Russia.

Jordan concludes that, in a measured way, advocates redistributedsocial and political power by means of their role as intermediaryactors between state and societal forces. However, she also warns thatsuch gains could be reversed if the Putin regime continues to flout dueprocess rights.

Описание: Winner of the American Sociological Association's 2019 Asia and Asian American Section Book Award
Winner of the American Sociological Association's 2019 Political Sociology Section Distinguished Contribution to Scholarship Book Award

Since the late 1970s, the three most salient minority groups in Japan - the politically dormant Ainu, the active but unsuccessful Koreans, and the former outcaste group of Burakumin - have all expanded their activism despite the unfavorable domestic political environment. In Rights Make Might,
Kiyoteru Tsutsui examines why, and finds an answer in the galvanizing effects of global human rights on local social movements. Tsutsui chronicles the transformative impact of global human rights ideas and institutions on minority activists, which changed their understandings about their standing in
Japanese society and propelled them to new international venues for political claim making. The global forces also changed the public perception and political calculus in Japan over time, catalyzing substantial gains for their movements. Having benefited from global human rights, all three groups
repaid their debt by contributing to the consolidation and expansion of human rights principles and instruments outside of Japan. Drawing on interviews and archival data, Rights Make Might offers a rich historical comparative analysis of the relationship between international human rights and local
politics that contributes to our understanding of international norms and institutions, social movements, human rights, ethnoracial politics, and Japanese society.
